In order to determine the responsibility of bidders, the\n\nawarding public agency may require prospective bidders, general\n\ncontractors, subcontractors and material suppliers to prequalify as\n\nresponsible bidders prior to submitting bids on a public\n\nconstruction contract. Prequalification to bid or perform work\n\npursuant to this section does not constitute a license. Except as\n\nprovided in subsection B of this section, prequalification shall not\n\nserve as a substitute for a license otherwise required by law.\n\nNotice of any such prequalification requirement shall be made\n\nequally and uniformly known by the awarding public agency to all\n\nprospective bidders and the public in the same manner as proposals\n\nto award public construction contracts as set forth in Section 104\n\nof this title. Financial information including, but not limited to,\n\naudited financial statements required by the awarding public agency\n\nas part of prequalification shall remain confidential.\n\nB. The Oklahoma Transportation Commission and the Oklahoma\n\nTransportation Authority may establish a system for prequalifying\n\nprospective bidders on construction and maintenance contracts to be\n\nawarded by the Commission or Authority. The Commission and the\n\nAuthority shall be the sole judge of the qualifications of\n\nprospective bidders and shall ascertain, to their exclusive\n\nsatisfaction, the qualifications of each prequalified bidder. Any\n\ncontractor or subcontractor prequalified as of the effective date of\n\nthis act performing signing, highway lighting, or traffic signal\n\ninstallation or maintenance for the Oklahoma Department of\n\nTransportation or the Oklahoma Transportation Authority shall be\n\nallowed to continue to bid and perform such work without obtaining\n\nany additional license from this state or any political subdivision\n\nof this state.
