If no timely bid is received after bid notices have been\n\npublished on any proposed public construction contract which does\n\nnot exceed One Hundred Thousand Dollars ($100,000.00) or on any\n\nproposed construction management trade contract or subcontract which\n\ndoes not exceed Fifty Thousand Dollars ($50,000.00):\n\n1. The governing body of a county, city, town or school\n\ndistrict may direct its employees or agents to negotiate the\n\ncontract with a prospective contractor; or\n\n2. The state agency, as defined in Section 202 of this title,\n\nshall request the Office of Management and Enterprise Services to\n\nnegotiate a contract on its behalf.\n\nB. The amount of a public construction contract which may be\n\nawarded by the governing body pursuant to this section shall not\n\nexceed One Hundred Thousand Dollars ($100,000.00), nor shall the\n\namount of a construction management trade contract or subcontract\n\nawarded by the governing body pursuant to this section exceed Fifty\n\nThousand Dollars ($50,000.00), and the work to be performed shall be\n\nas specified in the initial bidding documents. The contract shall\n\nbe executed within six (6) months after the date initially set for\n\nopening of bids.
