All statements or invoices submitted to the awarding public\n\nagency for work performed shall contain a certification by the\n\nsupervising architect or engineer, or other supervisory official if\n\nno supervisory architect or engineer is employed for the project,\n\nthat work for which payment is claimed has been performed and that\n\nsuch work conforms to the plans and specifications for the project.\n\nNo such statement or invoice shall be paid by the awarding public\n\nagency without such certification. The execution of a certificate,\n\nas herein provided, shall not constitute a defense or in any other\n\nmanner affect any cause or causes of action which the awarding\n\npublic agency might otherwise have against the contractor for\n\nnonperformance of a public construction contract.\n\nB. If project progressive payments are based on the public\n\nagency’s estimated quantities of materials provided and work\n\nperformed, certifications are not required. Payment of progressive\n\nestimates shall not constitute a defense or in any manner affect any\n\ncause or causes of action which the awarding public agency might\n\nhave against the contractor for failure to properly perform in\n\naccordance with the project contract, plans, specifications, or\n\nspecial provisions.
