The provisions of the Public Competitive Bidding Act of 1974\n\nwith reference to notice and bids shall not apply to an emergency\n\nif:\n\n1. The governing body of a public agency declares by a two-\n\nthirds (2/3) majority vote of all of the members of the governing\n\nbody that an emergency exists;\n\n2. The Transportation Commission and the Oklahoma Tourism and\n\nRecreation Commission, by majority vote of all the members of each\n\nCommission, declare that an emergency exists; or\n\n3. The chief administrative officer of a public agency without\n\na governing body declares that an emergency exists.\n\nB. The governing body of a public agency may, upon approval of\n\ntwo-thirds (2/3) majority of all of the members of the governing\n\nbody, delegate to the chief administrative officer of a public\n\nagency the authority to declare an emergency whereby the provisions\n\nof the Public Competitive Bidding Act of 1974 with reference to\n\nnotice and bids shall not apply to contracts less than One Hundred\n\nFifty Thousand Dollars ($150,000.00) in amount; provided, such\n\nauthority of the Department of Transportation and the Oklahoma\n\nTurnpike Authority shall not extend to any contract exceeding Seven\n\nHundred Fifty Thousand Dollars ($750,000.00) in amount and such\n\nauthority of the Department of Corrections shall not extend to any\n\ncontract exceeding Two Hundred Fifty Thousand Dollars ($250,000.00)\n\nin amount for situations in which the emergency impacts the\n\nconditions of confinement, health and safety of correctional\n\nofficers and inmates in the custody of the Department of\n\nCorrections.\n\nC. Upon approval of a two-thirds (2/3) majority vote, the\n\nOklahoma Conservation Commission may delegate to the Executive\n\nDirector the authority to declare an emergency and set a monetary\n\nlimit for the declaration. The provisions of this subsection may\n\nonly be used for the purpose of responding to an emergency involving\n\nthe reclamation of abandoned coal mines or the repair of damaged\n\nupstream floodwater retarding structures.\n\nD. An emergency declared by the Board of Corrections pursuant\n\nto subsection C of Section 65 of this title shall exempt the\n\nDepartment of Corrections from the limits which would otherwise be\n\nimposed pursuant to subsection B of this section for the contracting\n\nand construction of new or expanded correctional facilities.\n\nE. The chief administrative officer of a public agency with a\n\ngoverning body shall notify the governing body within ten (10) days\n\nof the declaration of an emergency if the governing body did not\n\napprove the emergency. The notification shall contain a statement\n\nof the reasons for the action, and shall be recorded in the official\n\nminutes of the governing body.\n\nF. Emergency as used in this section shall be limited to\n\nconditions resulting from a sudden unexpected happening or\n\nunforeseen occurrence or condition whereby the public health or\n\nsafety is endangered or further damage to state property is likely\n\nif the situation is not addressed promptly.\n\nG. The chief administrative officer of a public agency shall\n\nreport an emergency within ten (10) days of the emergency\n\ndeclaration and include the official minutes of the governing body\n\nof the public agency, if applicable, to the Office of Management and\n\nEnterprise Services which shall compile an annual report detailing\n\nall emergencies declared pursuant to this section during the\n\nprevious calendar year. The report shall be submitted to the\n\nGovernor, the President Pro Tempore of the Senate, and the Speaker\n\nof the House of Representatives upon request.\n\nH. The Risk Management Administrator of the Office of\n\nManagement and Enterprise Services may declare an emergency on\n\nbehalf of a public agency when an insurable loss has occurred which\n\nwould lead to further economic loss or additional property damage if\n\nnot addressed promptly. Such declaration shall not relieve the\nof the Senate, and the Speaker\n\nof the House of Representatives upon request.\n\nH. The Risk Management Administrator of the Office of\n\nManagement and Enterprise Services may declare an emergency on\n\nbehalf of a public agency when an insurable loss has occurred which\n\nwould lead to further economic loss or additional property damage if\n\nnot addressed promptly.
