In addition to any authority to enter an agreement pursuant\n\nto the Interlocal Cooperation Act, any school district, including a\n\ntechnology school district, may either participate in, sponsor,\n\nconduct or administer a cooperative purchasing agreement for the\n\nacquisition of any commodities or services with one or more public\n\nagencies in accordance with an agreement entered into between the\n\nparticipants. Such cooperative purchasing may include, but is not\n\nlimited to, joint or multiparty contracts between public agencies\n\nand open-ended state public procurement contracts. Cooperative\n\npurchasing shall not include new construction. For cooperative\n\npurchasing agreements, all funds shall be applied toward chargeables\n\nunder the agreements or toward direct administrative costs\n\nassociated with the agreements. No entity shall take a percentage\n\nof the funds as profit under the cooperative purchasing agreement.\n\nB. Any local public procurement unit may either participate in,\n\nsponsor, conduct or administer a cooperative or piggybacking\n\npurchasing agreement for the acquisition of any commodities or\n\nservices, including construction services, with one (1) or more\n\npublic procurement units or external procurement units in accordance\n\nwith an agreement entered into between the participants. Such\n\ncooperative purchasing may include, but is not limited to, joint or\n\nmultiparty contracts between public procurement units and open-ended\n\nstate public procurement unit contracts which are made available to\n\nlocal public procurement units. Purchases made in accordance with\n\nthis subsection by a local public procurement unit shall be required\n\nto satisfy any procurement regulation, including Oklahoma Central\n\nPurchasing Act, the Public Competitive Bidding Act of 1974, the\n\nOklahoma State Finance Act, related administrative rules and federal\n\nregulations that may apply due to the federal source of the funding\n\nfor the anticipated purchase.\n\nC. For purposes of this section, the following definitions\n\napply:\n\n1. “Local public procurement unit” shall mean, inter alia, any\n\ncounty, city, town, state agency, and any other subdivision of the\n\nstate or public unit or agency thereof;\n\n2. “External procurement unit” shall mean any buying\n\norganization in the United States not located in this state which,\n\nif located in this state, would qualify as a public procurement\n\nunit;\n\n3. “Cooperative or piggybacking purchasing agreement” shall\n\nmean an agreement between a local public procurement unit and\n\nanother local public procurement unit or an external procurement\n\nunit to authorize the use of a contract procured by one of the\n\nparties to the agreement to benefit the other party to the\n\nagreement. This term shall also mean an agreement that provides\n\naccess to a product or service that is lower in price than a\n\ncomparable product or service that is available through the usage of\n\na statewide, multistate or multigovernmental contract issued by the\n\nPurchasing Division of the Office of Management and Enterprise\n\nServices; and\n\n4. “New construction” shall mean any building not previously\n\nconstructed that has not been occupied or used. New construction\n\nshall not mean bus barns, agriculture barns, storage buildings,\n\nbatting cages, or similar structures.\n\nD. Nothing in this section shall supersede the obligation of a\n\nstate agency to adhere to rules regarding statewide contracts issued\n\nby the Purchasing Division.
