Stat. tit. 61, § 61-202.1","heading":"Design-build and at-risk construction management project","body":"delivery methods - Authorization required - Exemptions.\n\nA. The design-build and construction management project\n\ndelivery methods shall not be used without the written approval of\n\nthe Director of the Office of Management and Enterprise Services, or\n\nthe Director's designee, when those projects are constructed for a\n\nstate agency or by an act of the Legislature specifying design-build\n\nor at-risk construction management for a project. In all instances\n\nwhere the design-build project or at-risk construction management\n\ndelivery method is authorized, construction administration shall be\n\nperformed by the State Facilities Director, the SFD's designee or\n\ndesignees, or otherwise by contract or contract provision approved\n\nby the Director of the Office of Management and Enterprise Services\n\nfor construction administration by another party.\n\nB. The use of design-build and construction management project\n\ndelivery methods shall not interfere or inhibit the opportunity for\n\nsubcontractors and trade contractors to openly and freely compete\n\nfor subcontracts or trade contracts pursuant to the Public\n\nCompetitive Bidding Act of 1974. The State Facilities Director, or\n\ndesignee, or the construction manager shall make the subcontracting\n\nand supply opportunities publicly known, as follows:\n\n1. Whenever the estimated cost of the contract exceeds Fifty\n\nThousand Dollars ($50,000.00), public notice shall be given by\n\npublication in a newspaper of general circulation and published in\n\nthe county where the work, or the major part of the work, is to be\n\ndone. Such notice by publication shall be published in two\n\nconsecutive weekly issues of the newspaper, with the first\n\npublication thereof to be at least twenty-one (21) days prior to the\n\ndate set for opening bids; and\n\n2. Notice thereof shall be sent to one in-state trade or\n\nconstruction publication for the publication's use and information\n\nwhenever the estimated cost of the contract exceeds Fifty Thousand\n\nDollars ($50,000.00); provided, however, this section shall not be\n\nconstrued to require the publication of such notice in such trade or\n\nconstruction publication or to require the provision of such notice\n\nto more than one in-state trade or construction publication or to\n\nany out-of-state trade or construction publication.\n\nC. Bids shall be publicly opened at the time and place\n\ndesignated in the public notice. A representative of the State\n\nFacilities Director shall be present at the bid opening.\n\nD. The provisions of subsection A of this section shall not\n\napply to projects by contract pursuant to an interagency agreement\n\nunder Section 581 of Title 74 of the Oklahoma Statutes or to\n\nprojects a state agency performs solely with the staff of the\n\nagency.\n\nE.
