The Office of Management and Enterprise Services shall:\n\n1. Review and approve all construction plans and specifications\n\nto ensure compliance with good construction practices and space\n\nstandards, costs of project, proposed construction timetables, and\n\nagency need for the project;\n\n2. Inspect prior to acceptance and final payment all completed\n\nprojects for which the Office issued bid solicitations to ensure\n\ncompliance with the plans and specifications of the project;\n\n3. Select and hire consultants and construction managers for\n\nprojects as determined or approved by the Office. The Office shall\n\nselect, award and execute contracts to consultants and construction\n\nmanagers that provide services to state agencies subject to this\n\nact;\n\n4. Develop and issue solicitations for award of state agency\n\ncontracts for construction services. The Office shall have final\n\napproval authority for contracts and contract documents. Neither\n\nthe Office nor any public entity shall, for performance of work that\n\nrequires that a contractor be licensed by this state, issue a\n\nsolicitation to, or make a contract with, a contractor not licensed\n\nby this state;\n\n5. Review inspections performed by consultants and construction\n\nmanagers during construction, perform primary inspections when\n\nconsultants or construction managers are not used, and final\n\ninspections after completion;\n\n6. Establish standards and policies as required to standardize\n\nfacility assessment and benchmarking, facility operations and\n\nmaintenance, asset preservation, design and energy standards, space\n\nutilization, material testing, indexes of efficiency, economy, and\n\neffectiveness;\n\n7. Monitor indices of facility condition, effectiveness of\n\noperations and maintenance programs, deferred maintenance\n\nprioritization, effectiveness of planning processes, budgeting for\n\ncapital needs, application of facility standards as established by\n\nthe Office, and performance outcomes of construction projects to\n\nensure maximum efficiency in the expenditure of state funds for\n\nasset management and preservation of the state's capital real\n\nproperty;\n\n8. Coordinate, monitor and report on statewide energy\n\nconservation programs delegated to the Office;\n\n9. Provide property leasing and brokerage services delegated to\n\nthe Office;\n\n10. Report fraud or waste in any construction project by\n\nwritten notification with documentation for the report to the\n\nAttorney General. The Attorney General shall take appropriate\n\naction to protect the interest of the state; and\n\n11. Prequalify as good and sufficient insurance carriers,\n\nbonding companies and surety companies to meet provisions of\n\nSections 1 and 134 of this title. The Director shall promulgate\n\nrules to establish criteria to determine whether a carrier or\n\ncompany is good and sufficient. The prequalification requirement\n\nand process shall not violate the provisions of Section 135 of this\n\ntitle.\n\nB. When a state agency employs a licensed architect or licensed\n\nengineer as a full-time employee, said licensed employee may conduct\n\nrequired facility planning, prepare project plans and specifications\n\nand monitor construction work as prescribed by the Office. State\n\nagencies authorized to employ licensed architects and engineers for\n\nthe purposes of this section include:\n\n1. The Department of Transportation with respect to highways,\n\nbridges and dams;\n\n2. The Oklahoma State Regents for Higher Education and its\n\nconstituent institutions;\n\n3. The Military Department of the State of Oklahoma;\n\n4. The Oklahoma Tourism and Recreation Department; and\n\n5.
