Except as provided by subsection B of this section, no state\n\nagency shall employ, either temporary or full-time, any person\n\nengaged in the practice of architecture, engineering or land\n\nsurveying for the purpose of planning or performing any construction\n\nupon any real property belonging to the agency or to the state, or\n\nupon any real property of which this state will assume possession or\n\nownership by contract, option to purchase agreement, lease, or\n\notherwise. The term \"practice of architecture\" shall be defined as\n\nthose activities of an architect as provided for in Section 46.3 of\n\nTitle 59 of the Oklahoma Statutes. The terms \"practice of\n\nengineering\" or the \"practice of land surveying\" shall be defined as\n\nsuch terms are defined by Section 475.2 of Title 59 of the Oklahoma\n\nStatutes.\n\nB. The provisions of subsection A of this section shall not\n\napply to:\n\n1. The Department of Human Services;\n\n2. The Oklahoma Tourism and Recreation Department;\n\n3. The State Department of Health insofar as the monitoring of\n\npermitted health care facility construction for licensing purposes;\n\n4. The Oklahoma Historical Society insofar as the monitoring of\n\nhistorical site preservation and authenticity;\n\n5. The Office of Management and Enterprise Services;\n\n6. The State Department of Education and the public schools\n\nsubject to its jurisdiction;\n\n7. The Department of Transportation;\n\n8. The Oklahoma State System of Higher Education;\n\n9. The Military Department of the State of Oklahoma;\n\n10. The Oklahoma Municipal Power Authority;\n\n11. The Department of Public Safety gun range; and\n\n12.
