Shared savings contracts shall be developed in accordance\n\nwith a model contract developed by the Office of Management and\n\nEnterprise Services. The model contract shall include:\n\n1. The methodology for calculating baseline energy costs;\n\n2. A procedure for revising these costs should the state\n\ninstitute additional energy conservation features or structure use\n\nchange;\n\n3. A requirement for a performance bond guaranteeing that the\n\nstructure will be restored to the original condition in the event of\n\ndefault;\n\n4. A provision for early buyout;\n\n5. A clause specifying who will be responsible for maintaining\n\nthe equipment; and\n\n6. A provision allowing the disposal of equipment at the end of\n\nthe contract.\n\nNo state agency or department shall substantially alter the\n\nprovisions described in the model without the permission of the\n\nOffice.\n\nB.
