The Public Construction Management Act for Political\n\nSubdivisions shall apply to political subdivisions of this state.\n\nB. As used in the Public Construction Management Act for\n\nPolitical Subdivisions:\n\n1. \"Agency construction management\" means the construction\n\nentity provides services to the owner without taking on financial\n\nrisks for the execution of the actual construction and/or time of\n\nperformance, and the owner contracts directly with those awarded\n\ntrade contracts for the work;\n\n2. \"At-risk construction management\" means the construction\n\nentity, after providing agency services during the preconstruction\n\nperiod:\n\na. takes on the financial obligation to timely carry out\n\nconstruction under a specified cost agreement, and\n\nb. enters into written subcontracts for the work in\n\naccordance with the Construction Management Procedures\n\nfor Political Subdivisions;\n\n3. \"Construction management\" means a public construction\n\nproject delivery method based on an agreement whereby the owner\n\nacquires from a construction entity a series of services that\n\ninclude, but are not necessarily limited to, design review,\n\nscheduling, cost control, value engineering, constructability\n\nevaluation, preparation and coordination of bid packages and\n\nconstruction administration. Construction management includes:\n\na. agency construction management, and\n\nb. at-risk construction management; and\n\n4. \"Political subdivision\" or \"subdivision\" means any local\n\ngovernmental body formed pursuant to the laws of this state,\n\nincluding, but not limited to, school districts, vocational\n\neducation districts, cities, counties, public trusts, public\n\nauthorities, commissions or other local governmental bodies\n\nexercising their authority to contract for public construction\n\ndelivery services.
