Stat. tit. 61, § 61-222","heading":"Definitions","body":"\n\nAs used in the Fair Pay for Construction Act:\n\n1. “Construction contract” means a written contract or\n\nsubcontract awarded by an owner or contracting entity for the\n\npurpose of making any public improvements or constructing any public\n\nbuilding or making repairs to or performing maintenance on the same;\n\n2. “Material supplier” means any entity that supplies\n\nmaterials, services, or equipment to be used in conjunction with the\n\nperformance of work on a construction contract;\n\n3. “Prime contractor” means any entity that has a direct\n\ncontract with an owner to perform work under a construction\n\ncontract;\n\n4. “Owner” means any state government entity, municipality,\n\ntownship, public trust or an instrumentality of a state government\n\nentity, municipality, township or public trust in this state, or any\n\nentity designated by the owner to act on the owner’s behalf, that\n\nrequests work to be performed by a contractor under a construction\n\ncontract;\n\n5. “Proper invoice” means a request for payment or partial\n\npayment based on work performed on a construction contract;\n\n6. “Retainage” means the difference between a gross proper\n\ninvoice amount on a construction contract and the amount paid on\n\nsaid contract;\n\n7. “Subcontractor” means any entity that has a direct contract\n\nwith a prime contractor to perform a portion of the work under a\n\nconstruction contract; and\n\n8. “Sub-subcontractor” means any entity that has a direct\n\ncontract with another subcontractor to perform a portion of the work\n\nunder a construction contract.","path":["OK Code","Title 61"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os61.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bdd0e614cb0772a042c748a21564a65c0207dd94bdee1959a6b0df0a06675d52","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-61-61-221","next":"us-ok/okla.-stat.-tit.-61-61-223"},"notice":"GroundRules: Original legal text.
