Except as provided in subsection B of this section, eight\n\n(8) hours shall constitute a day's work for all public employees not\n\notherwise exempt from or covered by special provisions under the\n\nfederal Fair Labor Standards Act, 29 U.S.C.A., Section 201 et seq.\n\nand regulations thereto. In cases where it may be necessary to work\n\nmore than eight (8) hours per calendar day which results in more\n\nthan forty (40) hours worked per week, all public employees not\n\notherwise exempt from or otherwise covered by special provisions\n\nunder the federal Fair Labor Standards Act and regulations related\n\nthereto or other persons so employed shall be compensated in\n\naccordance with the federal Fair Labor Standards Act and regulations\n\nrelated thereto.\n\nB. Public employees and public safety professionals may be\n\nallowed to work in excess of eight (8) hours per day when such hours\n\nare assigned as part of an alternative work schedule. In any case\n\nwhere such work schedule results in an employee working in excess of\n\nforty (40) hours per workweek who is not exempt from or covered by\n\nspecial provisions under the overtime provisions of the Fair Labor\n\nStandards Act, the employee shall be compensated in accordance with\n\nthe Fair Labor Standards Act and regulations related thereto. For\n\npurposes of this section, “public safety professionals” means\n\nsheriffs, deputy sheriffs, correctional officers, and persons in the\n\nemergency medical service profession.\n\nR.L. 1910, § 3757.
