Any person may forage for nuts and edible plants or fungi on\n\nstate-owned or state-managed property accessible to the public for\n\npersonal consumption only except when such nuts and other edible\n\nplants or fungi are:\n\n1. From crops certified by the Oklahoma Agricultural Experiment\n\nStation system or the Oklahoma Cooperative Extension Service of the\n\nOklahoma State University Division of Agricultural Sciences and\n\nNatural Resources, as provided in Section 8-33 of Title 2 of the\n\nOklahoma Statutes; or\n\n2. From plants that are threatened or endangered.\n\nB. Any person foraging pursuant to this section is encouraged\n\nto:\n\n1. Wear an outer garment of hunter orange that is clearly\n\nvisible while in the field; and\n\n2. Recognize which nuts and edible plants or fungi are safe for\n\nhuman consumption.\n\nC. As used in this section:\n\n1. “State-owned or state-managed property accessible to the\n\npublic” means property owned or managed by an agency, municipality,\n\nor political subdivision of this state designated for public use,\n\nunless the property is located on:\n\na. state-owned or university-owned test or research\n\nfarms,\n\nb. land leased to an individual or entity pursuant to\n\nSection 1056 of Title 64 of the Oklahoma Statutes, who\n\nhas not given permission to an individual to forage,\n\nor\n\nc. property otherwise restricted for public access by\n\nstate or federal law including, but not limited to:\n\n(1) land along public roads, highways, turnpikes, and\n\ninterstates,\n\n(2) areas owned or operated by a law enforcement\n\nagency or used for law enforcement training, or\n\n(3) areas surrounding correction facilities owned or\n\noperated by the Department of Corrections, a\n\ncounty, a municipality, or a private entity\n\ncontracted by the Department of Corrections to\n\noperate in this state;\n\n2. “Edible plant or fungi” means a plant or fungi commonly\n\nfound in the wild, which is edible to humans in part or in its\n\nentirety and may require cooking to make safe for consumption;\n\n3. “Nut” means a dry fruit that has a single seed, a hard\n\nshell, and a protective husk; and\n\n4. \"Personal consumption\" means an amount that can be consumed\n\nin a few days by a person and not sold to another person.\n\nD. 1. After July 1, 2026, any person who is lawfully on a\n\nWildlife Management Area owned or managed by the Department of\n\nWildlife Conservation may forage along with other permitted\n\nactivities as authorized by the Oklahoma Wildlife Conservation\n\nCommission.\n\n2.
