The requirements of the Fair and Open Competition in\n\nGovernmental Construction Act do not apply to public construction\n\ncontracts executed before November 1, 2012.\n\nB. The Fair and Open Competition in Governmental Construction\n\nAct does not:\n\n1. Prohibit employers or other parties from entering into\n\nagreements or engaging in any other activity protected by the\n\nNational Labor Relations Act, 29 U.S.C., Sections 151 to 169;\n\n2. Interfere with labor relations of parties that are protected\n\nunder the National Labor Relations Act, 29 U.S.C., Sections 151 to\n\n169; or\n\n3. Prohibit a public agency from awarding a public contract,\n\ngrant, tax abatement, or tax credit to a private owner, bidder,\n\ncontractor, or subcontractor who enters into or who is party to an\n\nagreement with a collective bargaining organization, if being or\n\nbecoming a party or adhering to an agreement with a collective\n\nbargaining organization is not a condition for award of the public\n\ncontract, grant, tax abatement, or tax credit, and if the public\n\nagency does not discriminate against a private owner, bidder,\n\ncontractor, or subcontractor in the awarding of that grant, tax\n\nabatement, or tax credit based upon the status as being or becoming,\n\nor the willingness or refusal to become, a party to an agreement\n\nwith a collective bargaining organization.","path":["OK Code","Title 61"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os61.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1dbb65b92c6cab64b26ccba5dd0212a93d2c7458996ffc595f14cb469e6004c1","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-61-61-85","next":"us-ok/okla.-stat.-tit.-62-62-10.1"},"notice":"GroundRules: Original legal text.
