Stat. tit. 62, § 62-139.47","heading":"Specified emergencies - Expenditures without Board","body":"action.\n\nA. Where the written findings of fact required by Section\n\n139.46 of this title include one of the following emergencies, and\n\nthe Governor finds that such emergency exists, and was not foreseen\n\nor reasonably foreseeable by the Legislature, the Governor may\n\nallocate and authorize the expenditure of monies from the State\n\nEmergency Fund to provide for such emergency without any action by\n\nthe Contingency Review Board:\n\n1. Destruction of or damage to public property caused by fire,\n\nhail, tornado, explosion, windstorm, flood, or other catastrophe;\n\n2. Maintenance and operation of the National Guard when called\n\nto active state service in cases of emergency;\n\n3. Allocation or expenditures necessary to provide matching\n\nfunds for participation in any federal disaster relief program,\n\nemergency equipment purchase, or otherwise expedite receipt of\n\ndisaster funds;\n\n4. Allocations or expenditures deemed necessary to remove\n\nasbestos from public buildings or facilities;\n\n5. Emergency response action necessary to protect the public\n\nhealth, safety or welfare or livestock, wild animals, birds, fish or\n\nother aquatic life from the discharge of any hazardous waste,\n\ndeleterious substance or any such other waste or substance as will\n\nor is likely to be detrimental or cause injury to the public or such\n\nlivestock, wild animals, birds, fish or other aquatic life;\n\n6. Funding for funeral expenses not to exceed Seven Thousand\n\nDollars ($7,000.00) for state employees who are killed in the line\n\nof their duty and funding for premiums for six (6) months of\n\ninsurance coverage already in force for spouse and dependents who\n\nare eligible for survivor coverage of those employees pursuant to\n\nrules of the Oklahoma State and Education Employees Group Insurance\n\nBoard, provided, that if funds in the State Emergency Fund are\n\ninsufficient to cover these expenses, the employing agency of the\n\nemployees shall pay the expenses;\n\n7. Allocation or expenditures necessary to provide funds for\n\ndisaster relief programs to political subdivisions for damage caused\n\nby fire, hail, tornado, explosion, windstorm, flood or other\n\ncatastrophe for which federal disaster relief funds have been\n\nrequested by the Governor and rejected by the Federal Emergency\n\nManagement Agency (FEMA). Provided, that no political subdivision\n\nshall be deemed eligible for an allocation or expenditure of funds\n\nfrom the State Emergency Fund under this paragraph unless such area\n\nhas first been deemed a disaster area by an executive declaration by\n\nthe Governor of the State of Oklahoma; and\n\n8. Allocation or expenditures necessary to provide funds for\n\ncooperative actions with the United States Army Corps of Engineers\n\nto respond to emergencies or to protect the public health, safety,\n\nor welfare.\n\nB. Expenditures made to political subdivisions under this\n\nsection shall be audited and processed by the Oklahoma Department of\n\nEmergency Management. No application for an allocation or\n\nexpenditure of funds shall be made until it is certified by the\n\npolitical subdivision that no other monies are available to\n\nreimburse the requesting entity for expenditures made as a result of\n\nthe catastrophe. No geographical area which has been declared a\n\ndisaster area by the Governor may receive an allocation of funds\n\nunder this section in excess of One Hundred Thousand Dollars\n\n($100,000.00) in a calendar year.\n\nProvided further, that the Governor shall allocate, without any\n\naction by the Contingency Review Board, monies from the State\n\nEmergency Fund to pay expenses for the Court on the Judiciary\n\napproved pursuant to Section 16.6 of Title 20 of the Oklahoma\n\nStatutes and not otherwise funded by other legislative\n\nappropriations.","path":["OK Code","Title 62"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os62.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b2a395dffbe66f15a69b3ec5fe025d019e78b0bc15f6ab56a5c144d7d30402f3","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-62-62-139.46","next":"us-ok/okla.-stat.-tit.-62-62-139.48"},"notice":"GroundRules: Original legal text.
