Stat. tit. 62, § 62-193","heading":"Ad Valorem Reimbursement Fund - Claims - Distribution of","body":"funds.\n\nA. There is hereby created in the State Treasury a revolving\n\nfund for the Oklahoma Tax Commission to be designated the \"Ad\n\nValorem Reimbursement Fund\". The fund shall be a continuing fund,\n\nnot subject to fiscal year limitations. Monies apportioned to this\n\nfund shall be expended:\n\n1. To reimburse counties of this state for loss of revenue due\n\nto exemptions of ad valorem taxes for new or expanded manufacturing\n\nor research and development facilities;\n\n2. Beginning calendar year 2022 and all subsequent years, to\n\nreimburse qualified counties of this state for loss of revenue due\n\nto exemptions granted to veterans and their surviving spouses\n\npursuant to the provisions of Sections 8D, 8E and 8F of Article X of\n\nthe Oklahoma Constitution. A county is qualified for reimbursement\n\nif the number of exemptions granted to veterans and surviving\n\nspouses for the most recently concluded calendar year exceeds eight-\n\ntenths of one percent (0.8%) of the total county population\n\naccording to the latest Federal Decennial Census or most recent\n\nannual population estimate, whichever is most recent. The\n\nreimbursement provided in this paragraph shall amount to twenty-five\n\npercent (25%) of the loss of revenue claimed by the qualified\n\ncounty;\n\n3. To reimburse counties of this state for loss of revenue for\n\nschool district and county purposes due to exemptions granted\n\npursuant to the provisions of Section 2890 of Title 68 of the\n\nOklahoma Statutes; and\n\n4. To reimburse counties of this state for loss of revenue due\n\nto decreased valuation and assessment for buffer strips pursuant to\n\nSection 2817.2 of Title 68 of the Oklahoma Statutes.\n\nProvided that it shall be the duty of the Tax Commission to\n\nassess the valuation of all property for new or expanded\n\nmanufacturing or research and development facilities which are\n\nexempt from ad valorem taxes.\n\nMonies apportioned to this fund also may be transferred to other\n\nstate funds or otherwise expended as directed by the Legislature by\n\nlaw.\n\nB. The county commissioners of each county seeking\n\nreimbursement for lost revenue from the Ad Valorem Reimbursement\n\nFund shall make claims for reimbursement on forms prescribed by the\n\nTax Commission prior to April 30 of each year. Claims for\n\nreimbursement for loss of revenue based upon the type of exemptions\n\nauthorized pursuant to subsection A of this section. Provided, the\n\nassessed valuation of a school district as stated in the claim for\n\nreimbursement shall be the same as reported to the State Department\n\nof Education on the Estimate of Need and shall include the total\n\nvaluation of property exempt from taxation pursuant to Section 2902\n\nof Title 68 of the Oklahoma Statutes. The claims shall be either\n\napproved or disapproved in whole or in part by the Tax Commission by\n\nJune 15 of each year. A claim for reimbursement for loss of revenue\n\ndue to an exemption of ad valorem taxes for a new or expanded\n\nmanufacturing or research and development facility shall be\n\ndisapproved if a county or school district has received any payment\n\nin lieu of ad valorem taxes from such facility, to the extent of the\n\namount of such reimbursement. If the Tax Commission determines that\n\nan exemption has been erroneously or unlawfully granted, it shall\n\nnotify the appropriate county assessor who shall immediately value\n\nand assess the property and place it on the rolls for ad valorem\n\ntaxation. Disbursements from the fund shall be made on warrants\n\nissued by the State Treasurer against claims filed by the Tax\n\nCommission with the Office of Management and Enterprise Services for\n\npayment. Such disbursements shall be exempt from all agency\n\nexpenditure ceilings. The county treasurer shall apportion or\n\ndisburse such funds for expenditures in the same manner as other ad\n\nvalorem tax collections.\n\nC. In the event monies apportioned to the Ad Valorem\ned by the State Treasurer against claims filed by the Tax\n\nCommission with the Office of Management and Enterprise Services for\n\npayment. Such disbursements shall be exempt from all agency\n\nexpenditure ceilings. The county treasurer shall apportion or\n\ndisburse such funds for expenditures in the same manner as other ad\n\nvalorem tax collections.\n\nC. In the event monies apportioned to the Ad Valorem\n\nReimbursement Fund are insufficient to pay all claims for\n\nreimbursement made pursuant to subsection B of this section, claims\n\nfor reimbursement for loss of revenue due to exemptions of ad\n\nvalorem taxes for new or expanded manufacturing or research and\n\ndevelopment facilities shall be paid first, and any remaining funds\n\nshall be distributed proportionally among the counties making claims\n\nfor reimbursement for loss of revenue for school district and county\n\npurposes due to exemptions granted pursuant to the provisions of\n\nSections 8D, 8E and 8F of Article X of the Oklahoma Constitution, if\n\napplicable, according to the amount of the claim made by each\n\ncounty. If any funds remain after paying all claims for\n\nreimbursement for loss of revenue due to exemptions of ad valorem\n\ntaxation for new or expanded manufacturing or research and\n\ndevelopment facilities and for reimbursement for loss of revenue for\n\nschool district and county purposes due to exemptions granted\n\npursuant to the provisions of Sections 8D, 8E and 8F of Article X of\n\nthe Oklahoma Constitution, the remaining funds shall be distributed\n\nproportionally among the counties making claims for reimbursement\n\nfor the exemptions granted pursuant to the provisions of Section\n\n2890 of Title 68 of the Oklahoma Statutes and for the loss of\n\nrevenue for decreased valuation and assessment for buffer strips\n\npursuant to Section 2817.2 of Title 68 of the Oklahoma Statutes.","path":["OK Code","Title 62"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os62.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ed48e91a7f1c3bcc748824d6913c2ebaa4c4e8eb5f062dc380496ee8258b0457","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-62-62-189","next":"us-ok/okla.-stat.-tit.-62-62-194"},"notice":"GroundRules: Original legal text.
