Stat. tit. 62, § 62-2003","heading":"Administration of Rural Economic Action Plan grant","body":"program – Distribution of monies - Limitations.\n\nA. Monies appropriated by law to the Oklahoma Water Resources\n\nBoard for the purpose of funding the Rural Economic Action Plan\n\ngrant program and the Rural Economic Action Plan Water Projects Fund\n\nshall be administered by the Oklahoma Water Resources Board as\n\nprovided by this section.\n\nB. The monies referred to in subsection A of this section shall\n\nbe distributed to eligible cities and towns, unincorporated areas or\n\nother qualified entities located within the areas represented by the\n\nfollowing organizations:\n\n1. Association of Central Oklahoma Governments (ACOG);\n\n2. Association of South Central Oklahoma Governments (ASCOG);\n\n3. Central Oklahoma Economic Development District (COEDD);\n\n4. Eastern Oklahoma Economic Development District (EOEDD);\n\n5. Grand Gateway Economic Development Association (GGEDA);\n\n6. Indian Nations Council of Governments (INCOG);\n\n7. Kiamichi Economic Development District (KEDDO);\n\n8. Northern Oklahoma Development Association (NODA);\n\n9. Oklahoma Economic Development Association (OEDA);\n\n10. Southern Oklahoma Development Association (SODA); and\n\n11. South Western Oklahoma Development Authority (SWODA).\n\nC. The monies referred to in subsection A of this section shall\n\nnot be expended for the benefit of cities or towns with a population\n\nin excess of seven thousand (7,000) persons according to the latest\n\nFederal Decennial Census. Funds may also be expended for any city\n\nor town with a population below seven thousand (7,000) persons based\n\nupon the current population estimate according to the U.S. Census\n\nBureau. Funds may be expended for such cities and towns until the\n\nnext following Federal Decennial Census. Any municipality may enter\n\ninto an agreement with an entity described in subsection B of this\n\nsection to apply for available funds described by this section if\n\nthe municipality is located within the area served by the entity.\n\nUpon approval of the application, funds shall be paid to the\n\nmunicipality requesting the funds.\n\nD. An entity described in subsection B of this section may\n\napply for a grant to be used for the benefit of an unincorporated\n\narea within a county served by that entity if the area benefited\n\ndoes not contain a population in excess of seven thousand (7,000)\n\npersons. Any county may enter into an agreement with an entity\n\ndescribed in subsection B of this section if the county is located\n\nwithin the area served by the entity. Upon approval of the\n\napplication, funds shall be paid to the county requesting the funds.\n\nE. The monies referred to in subsection A of this section may\n\nbe expended for water quality projects, including but not limited to\n\nsewer line construction or repair and related storm or sanitary\n\nsewer projects, water line construction or repair, water treatment,\n\nwater acquisition, distribution or recovery and related projects.\n\nF. Any city or town with a population less than one thousand\n\nseven hundred fifty (1,750) persons according to the latest Federal\n\nDecennial Census shall have a higher priority for funds allocated by\n\nthe Oklahoma Water Resources Board from the amount referred to in\n\nsubsection A of this section than jurisdictions of greater size.\n\nAmong such cities or towns, those municipalities having relatively\n\nweaker fiscal capacity shall have a priority for project funding in\n\npreference to other municipalities.\n\nG. The Oklahoma Water Resources Board shall establish ten\n\nseparate accounts containing one-tenth (1/10) of the amount annually\n\nappropriated to the Rural Economic Action Plan Water Projects Fund\n\nper account. Each account shall be available for distribution to\n\nqualified entities located within the area served by entities\n\ndescribed in subsection A of Section 2007 of this title or for\n\ndistribution to benefit unincorporated areas with the exception of\n\none account which shall be divided equally into two subaccounts.\nually\n\nappropriated to the Rural Economic Action Plan Water Projects Fund\n\nper account. Each account shall be available for distribution to\n\nqualified entities located within the area served by entities\n\ndescribed in subsection A of Section 2007 of this title or for\n\ndistribution to benefit unincorporated areas with the exception of\n\none account which shall be divided equally into two subaccounts.\n\nEach one of the two subaccounts shall be available for distribution\n\nto qualified entities located within the respective jurisdiction of\n\none of the entities described by subsection B of Section 2007 of\n\nthis title or for distribution to benefit unincorporated areas. No\n\nfunds deposited into one account or subaccount shall be transferred\n\nto any other account. The total expenditure from any one account or\n\nsubaccount for each fiscal year may not exceed the amount of funds\n\navailable to each account as may be provided by law.\n\nH. No city, town or other entity to which funds will be awarded\n\npursuant to this section shall be required to provide any form of\n\nmatch to obtain the funds, whether through cash, services or any\n\nother method.\n\nI. The Oklahoma Water Resources Board shall not be allowed to\n\nretain any of the funds referred to in subsection A of this section\n\nfor administration. All such funds shall be distributed to eligible\n\nentities as authorized by law.\n\nJ. In order to ensure fair and equitable distribution of the\n\nfunds referred to in subsection A of this section, the Oklahoma\n\nWater Resources Board shall promulgate rules for administering,\n\ndetermining priority of, approving and funding applications for such\n\nfunds. The rules shall implement the provisions of this section\n\nincluding the following:\n\n1. No qualified entity shall be approved nor funded for more\n\nthan Three Hundred Fifty Thousand Dollars ($350,000.00) from such\n\nfunds in any twelve-month period;\n\n2. If a qualified entity has previously been approved for or\n\nreceived such funds and makes a subsequent application, that\n\nsubsequent application may be assigned lower priority than an\n\napplication by qualified entities who have not previously been\n\napproved for or received such funds;\n\n3. In order to prevent substantially the same entity or area\n\nfrom receiving an undue advantage, a political subdivision and all\n\nits public trusts and similar subordinate entities together shall be\n\ntreated as one and the same qualified entity; provided rural water\n\nor sewer districts shall not be construed to be subordinate entities\n\nof counties unless the effect would be to make multiple grants to\n\nsubstantially the same entity or service area; and\n\n4.
