The governing board of an entity described by subsection A\n\nor B of Section 4 of this act shall develop a plan for the use of\n\navailable funds for providing matching amounts as required pursuant\n\nto the terms of applicable federal law to obtain federal funds for\n\nthe prevention of damage or to repair damages caused by a qualifying\n\nhazard within areas included within its respective jurisdiction.\n\nFor purposes of this act, \"qualifying hazard\" shall include, but\n\nshall not be limited to, potential damage or actual damages caused\n\nby any one or more of the following conditions or causes:\n\n1. High winds;\n\n2. Tornadoes;\n\n3. Hail;\n\n4. Rain;\n\n5. Flooding;\n\n6. Freezing rain or ice;\n\n7. Heavy snow;\n\n8. Wildfires;\n\n9. Seismic disturbances; or\n\n10. Other hazardous condition, whether naturally occurring or\n\nresulting from manmade conditions, having the potential to cause or\n\nhaving actually caused damage to public infrastructure assets and\n\nfor which federal funds may be available pursuant to a declaration\n\nof a disaster by the Governor or pursuant to terms of federal law.\n\nB. Not later than July 31, each entity described by Section 4\n\nof this act shall transmit, in such electronic form as may be\n\nprescribed by the Oklahoma Department of Commerce for purposes of\n\naccess to such information on the website maintained by the\n\nDepartment, a summary of each project upon which matching funds\n\nreceived by the entity from the Oklahoma Disaster Mitigation and\n\nRecovery Matching Fund were expended during the fiscal year ending\n\non the June 30 date immediately preceding the July 31 reporting\n\ndate.\n\nC. No entity which qualifies for funds pursuant to the\n\nprovisions of this act shall be required to provide matching funds\n\nor to provide equivalent value in order to obtain available funds or\n\nfunds for planning expenditures from the Oklahoma Disaster\n\nMitigation and Recovery Matching Fund.\n\nD. No funds allocated pursuant to the provisions of the\n\nOklahoma Disaster Mitigation and Recovery Matching Fund Act shall be\n\nused for any purpose other than to provide matching funds, available\n\nthrough the federal government or other sources as authorized by\n\nlaw, to maximize and leverage such available funding, and the funds\n\nallocated pursuant to the provisions of this act shall not be used\n\nfor any direct expenditures on salaries, employee benefits,\n\nacquisition of real or personal property, other than the available\n\nfunding for which the allocated funds may be utilized, or any other\n\npurpose.","path":["OK Code","Title 62"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os62.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d13b05a77181a4ca6c1a14ba4a53e0ddd5c356e8a72154a60e91937b3e6820e7","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-62-62-2022","next":"us-ok/okla.-stat.-tit.-62-62-2024"},"notice":"GroundRules: Original legal text.
