Stat. tit. 62, § 62-2203.2","heading":"Definitions","body":"As used in the Oklahoma Disaster Relief Materials Price\n\nStabilization Act:\n\n1. \"Cost to the retailer\" means the invoice cost of the\n\nmerchandise to the retailer or the replacement cost of the\n\nmerchandise to the retailer, whichever is the lower; less all trade\n\ndiscounts except customary discounts for cash; to which shall be\n\nadded:\n\na. freight charges not otherwise included in the invoice\n\ncost or the replacement cost of the merchandise,\n\nb. cartage to the retail outlet if done or paid for the\n\nretailer, which cartage cost, in the absence of proof\n\nof a lesser cost, shall be deemed to be three-fourths\n\nof one percent (3/4 of 1%) of the cost to the retailer\n\nas herein defined after adding freight charges, but\n\nbefore adding cartage and taxes,\n\nc. all state and federal taxes, and\n\nd. a markup to cover a proportionate part of the cost of\n\ndoing business, which markup, in the absence of proof\n\nof a lesser cost, shall be six percent (6%) of the\n\ncost of the retailer after adding freight charges and\n\ncartage, but before adding a markup;\n\n2. \"Cost to the wholesaler\" means the invoice cost of the\n\nmerchandise to the wholesaler, or the replacement cost of the\n\nmerchandise to the wholesaler, whichever is the lower; less all\n\ntrade discounts except customary discounts for cash; to which shall\n\nbe added:\n\na. freight charges, not otherwise included in the invoice\n\ncost or the replacement cost of the merchandise,\n\nb. cartage to the retail outlet if done or paid for by\n\nthe wholesaler, which cartage cost, in the absence of\n\nproof of a lesser cost, shall be deemed to be three-\n\nfourths of one percent (3/4 of 1%) of the cost to the\n\nwholesaler after adding freight charges, but before\n\nadding cartage and taxes, and\n\nc. all state and federal taxes;\n\n3. \"Disaster relief materials\" means those structural elements\n\nthat typically sustain damage during temporary conditions,\n\nincluding, but not limited to: lumber and lumber composites,\n\nengineered wood products, structural wood panels, roofing,\n\nguttering, siding, drywall, insulation, flooring, windows, doors and\n\nplumbing elements;\n\n4. \"Excessive price\" means a price exceeding one hundred ten\n\npercent (110%) of the highest price charged by the retailer or\n\nwholesaler for the item within the previous thirty (30) days;\n\n5. \"Replacement costs\" means the cost per unit at which the\n\nmerchandise sold or offered for sale could have been bought by the\n\nseller at any time within thirty (30) days prior to the date of sale\n\nor the date upon which it is offered for sale by the seller if\n\nbought in the same quantity or quantities as the seller's last\n\npurchase of such merchandise;\n\n6. \"Retailer\" means and includes every person, partnership,\n\ncorporation or association engaged in the business of making sales\n\nof retail disaster relief materials within this state; provided\n\nthat, in the case of a person, partnership, corporation or\n\nassociation engaged in the business of making both sales at retail\n\nand sales at wholesale, such term shall be applied only to the\n\nretail portion of such business;\n\n7. \"Sell at retail\", \"sales at retail\", \"retail sale\", \"sell at\n\nwholesale\", \"sales at wholesale\" or \"wholesale sales\" means any\n\ntransfer for a valuable consideration made in the ordinary course of\n\ntrade or the usual conduct of the seller's business of title to\n\npersonal property to the purchaser for purposes of resale or further\n\nprocessing or manufacturing. The above terms shall include any\n\ntransfer of such property where title is retained by the seller as\n\nsecurity for the payment of the purchase price;\n\n8. \"Temporary conditions\" means conditions lasting seven (7)\n\ndays or less such as tornado, hail storm, ice storm or blizzard. It\n\ndoes not include conditions lasting longer than seven (7) days such\n\nas drought or low temperatures; and\n\n9. \"Wholesaler\" means and includes every person, partnership,\nh property where title is retained by the seller as\n\nsecurity for the payment of the purchase price;\n\n8. \"Temporary conditions\" means conditions lasting seven (7)\n\ndays or less such as tornado, hail storm, ice storm or blizzard.
