The Board of Directors of the Tobacco Settlement Endowment\n\nTrust Fund shall be empowered to:\n\n1. Appoint an executive director and other staff necessary to\n\nperform the duties of the Board of Directors;\n\n2. Make and execute contracts and other instruments necessary\n\nor convenient to the exercise of its powers on such terms and for\n\nsuch period of time as the Board of Directors shall determine; and\n\n3. Promulgate rules in accordance with the Administrative\n\nProcedures Act and not inconsistent with the Tobacco Settlement\n\nEndowment Trust Fund Act to implement its duties and\n\nresponsibilities as provided by law.\n\nB. Funding for capital expenditures and operating expenses\n\nincurred by the University of Oklahoma Health Sciences Center and\n\nthe Oklahoma State University College of Osteopathic Medicine, for\n\neducational programs and residency training to maintain or improve\n\nthe health of Oklahomans or to enhance the provision of health care\n\nservices to Oklahomans, is hereby deemed to be an allowable purpose\n\nfor which earnings from the trust fund may be expended pursuant to\n\nthe provisions of paragraph 3 of subsection E of Section 40 of\n\nArticle X of the Oklahoma Constitution. Pursuant to its authority\n\nas set forth in subsection G of Section 40 of Article X of the\n\nOklahoma Constitution, the Legislature hereby authorizes the Board\n\nto expend earnings from the trust fund for such purposes, in\n\naddition to other purposes provided by law.\n\nC. The Board shall develop a multiyear strategy by January 1,\n\n2002, and annually update it in order to guide the Board's funding\n\nfor those programs set forth in Section 40 of Article X of the\n\nOklahoma Constitution. The strategy shall be used to maximize the\n\noutcomes of the grants awarded by the Board of Directors.\n\nD. The Board of Directors shall develop grant programs for\n\nprivate, nonprofit, and public entities for the purposes set forth\n\nin Section 40 of Article X of the Oklahoma Constitution.\n\n1. The selection and awarding of grants, whether in the form of\n\nprofessional service contracts or any other funding mechanism\n\ndeveloped by the Board of Directors, awarded pursuant to grant\n\nprograms developed under this subsection, shall be exempt from the\n\nrequirements of The Oklahoma Central Purchasing Act.\n\n2. The Board of Directors shall develop competitive processes\n\nfor awarding grants under programs developed under this subsection.\n\nSuch competitive processes for selection shall not be required for\n\ncontracts awarded for program support services, including, but not\n\nlimited to, professional service contracts to evaluate, audit or\n\nprovide budgeting, accounting, auditing or legal services for\n\nspecific programs or program grantees, contractors or participants.\n\n3. The Board of Directors may promulgate rules to assist in the\n\nimplementation and administration of grant programs developed under\n\nthis subsection.\n\n4. The terms of any request for proposals, request for\n\napplications, invitation for bid, bid notice, or grant proposal or\n\nany other solicitation issued by the Board of Directors to solicit\n\nor invite applications, proposals, bids or responses to obtain\n\nfunding under grant programs developed under this subsection shall\n\nbe confidential until the date and time at which the solicitation is\n\nto be made equally and uniformly known to all prospective applicants\n\nand the public, at which point all such documents and information\n\nshall be uniformly known to all prospective applicants and the\n\npublic, at which point all such documents and information shall be\n\nsubject to the Oklahoma Open Records Act and Oklahoma Open Meeting\n\nAct. Any application, proposal, bid, or any other document to\n\nobtain funding responsive to any solicitation of the Board of\n\nDirectors under grant programs developed under this subsection shall\ncants and the\n\npublic, at which point all such documents and information shall be\n\nsubject to the Oklahoma Open Records Act and Oklahoma Open Meeting\n\nAct. Any application, proposal, bid, or any other document to\n\nobtain funding responsive to any solicitation of the Board of\n\nDirectors under grant programs developed under this subsection shall\n\nbe confidential until the date and time of award of the grant or\n\ncontract, at which point all such documents and information shall be\n\nsubject to the Oklahoma Open Records Act and Oklahoma Open Meeting\n\nAct. Any unsolicited application, proposal, bid, or any other\n\ndocument to obtain funding shall not be considered to be\n\nconfidential and shall be subject to the Oklahoma Open Records Act\n\nand Oklahoma Open Meeting Act at all times.\n\nE. The Board of Directors shall encourage grantees to match\n\ngrant monies awarded with monetary commitments and in-kind matches.\n\nF. The Board of Directors shall be required to develop a\n\nperformance evaluation component for the Board of Directors'\n\nactivities and those of its grantees so that the performance of\n\ngrantees can be measured by their attainment of outcomes.\n\nG. The Board of Directors shall contract periodically for\n\nperformance evaluations. Copies of the evaluations shall be filed\n\nwith the Governor, the Speaker of the House of Representatives, and\n\nthe President Pro Tempore of the Senate.\n\nH. The Board of Directors shall prepare an annual report\n\ndetailing the Board of Directors' activities and reporting its\n\nexpenditures and the outcomes achieved by the expenditures. A copy\n\nof the report shall be submitted to the Governor, the Speaker of the\n\nHouse of Representatives, and the President Pro Tempore of the\n\nSenate.\n\nI.
