Stat. tit. 62, § 62-3107","heading":"Retirement bills having fiscal impact - Procedure -","body":"Amendments.\n\nA. 1. Except as otherwise provided in this subsection, any\n\nretirement bill having a fiscal impact may be introduced according\n\nto the applicable deadlines established by the House of\n\nRepresentatives or Senate only in any odd-numbered year during the\n\nregular session. Any such retirement bill may be passed by the\n\nLegislature only during an even-numbered year of the regular\n\nsession. Any retirement bill determined by the Legislative Actuary\n\nin an even-numbered year to be a fiscal retirement bill may be\n\nintroduced in an even-numbered year, but shall not be considered by\n\nthe Legislature.\n\n2. Notwithstanding the provisions of paragraph 1 of this\n\nsubsection, any retirement bill having a fiscal impact may be\n\nintroduced, considered and enacted in any year of a regular session\n\nof the Legislature if such retirement bill is introduced solely for\n\nthe purpose of an unforeseen or emergency situation that needs to be\n\naddressed immediately. Such retirement bill shall only be\n\nconsidered if three-fourths (3/4) of the membership of each House\n\nvotes to allow the retirement bill to be considered. Such\n\nretirement bill shall be subject to an actuarial investigation by\n\nthe Legislature Actuary in the year the bill is introduced and\n\nconsidered and shall require concurrent funding, if applicable.\n\nB. When a retirement bill having a fiscal impact is introduced,\n\nit shall be assigned to the respective Senate or House of\n\nRepresentatives standing committee or subcommittee that is primarily\n\nresponsible for the consideration of retirement legislation. If a\n\nmajority of the total membership of such committee is opposed to the\n\nbill on its merits, no actuarial investigation provided for in\n\nSection 3109 of this title shall be necessary, and the bill shall\n\nnot be reported out by the committee and shall not be adopted or\n\nconsidered by the House of Representatives or the Senate. If a\n\nmajority of the committee wishes to consider the bill further and\n\nvotes in favor of an actuarial investigation of the bill, an\n\nactuarial investigation shall be required as provided in Section\n\n3109 of this title. Except as otherwise provided by subsection C of\n\nthis section, no retirement bill having a fiscal impact may be\n\nreported out of the committee to which it is assigned or may be\n\nconsidered or adopted by the House of Representatives or the Senate\n\nunless an actuarial investigation of the bill is made.\n\nC. The committee to which a retirement bill having a fiscal\n\nimpact is assigned following its introduction may amend the bill to\n\nbecome a nonfiscal retirement bill. If the bill is so amended, an\n\nexact copy of the amended version shall be submitted by the chair of\n\nthe committee to the Legislative Actuary. If the Legislative\n\nActuary issues a written certification that the committee amendment\n\nhas converted the status of the bill to a nonfiscal retirement bill,\n\nthe bill shall be a nonfiscal retirement bill for all purposes under\n\nthe provisions of this act as of the date of the certification of\n\nthe Legislative Actuary.
