When a retirement bill having a fiscal impact has had an\n\nactuarial investigation pursuant to Section 3109 of this title, the\n\nbill may be considered at the next regular session of the\n\nLegislature. If the bill as originally introduced was not changed\n\nby the committee and the original version was submitted to the\n\nLegislative Actuary for an actuarial investigation, then the\n\noriginal version of the bill is the only one, except as otherwise\n\nprovided by subsection B of this section, which may be considered by\n\nthe committee or by the House of Representatives or the Senate. If\n\nthe original bill was substituted by the committee and the\n\nsubstitute version was the one submitted to the Legislative Actuary,\n\nthen that substitute bill is the only one, except as otherwise\n\nprovided by subsection B of this section, which may be considered by\n\nthe committee or by the House of Representatives or the Senate.\n\nB. After completion of an actuarial investigation, any\n\namendment to a retirement bill having a fiscal impact shall be out\n\nof order and shall not be allowed either by a committee or by the\n\nHouse of Representatives or the Senate, except for a nonfiscal or a\n\nreduction in cost amendment. Any amendment to a retirement bill\n\nhaving a fiscal impact shall be submitted to the Legislative Actuary\n\nby the chair of the committee, if a committee amendment, or by the\n\npresiding officer of the Senate or the House of Representatives if\n\nthe amendment was made by the Senate or the House of\n\nRepresentatives. If the Legislative Actuary certifies in writing\n\nthat the amendment is a nonfiscal amendment or if the amendment\n\nresults in a reduction in cost and the Legislative Actuary provides\n\nan actuarial investigation as required in subsection A of Section 9\n\nof this act, then the bill as amended, with the Legislative\n\nActuary’s certification or actuarial investigation attached to the\n\noriginal of the amendment, may continue in the legislative process.\n\nIf the Legislative Actuary will not issue such a certification for\n\nthe amendment or if there is no actuarial study showing the reduced\n\ncost of the amendment, the bill’s progress in the legislative\n\nprocess will end, and the bill shall not be considered further by\n\neither the House of Representatives or the Senate.\n\nC. An amendment to a retirement bill having a fiscal impact\n\nwhich is prohibited by subsection B of this section may be withdrawn\n\nby the committee which made the amendment, if a committee amendment,\n\nor by the Senate, if that body made the amendment, or by the House\n\nof Representatives, if that body made the amendment.
