Any retirement bill having a fiscal impact which is enacted\n\nby the Legislature and which is approved by the Governor or which\n\notherwise becomes law shall become effective on the first day of\n\nJuly immediately following the regular session during which it was\n\nenacted, but only if the enacted bill is concurrently funded as\n\nprovided by this section and only if the bill is approved as an\n\nemergency measure by a vote of two-thirds (2/3) of all members\n\nelected to each House. If an enacted bill does not receive a two-\n\nthirds (2/3) vote of all members, the law shall become effective on\n\nthe first day of September immediately following the regular session\n\nduring which it was enacted. If an enacted bill, including one\n\napproved by the Governor, is not concurrently funded as required by\n\nthis section, then such bill shall not become effective as law.\n\nB. When a retirement bill having a fiscal impact amends a\n\nretirement system having employer contributions funded from\n\nappropriations by the Legislature, then appropriations for the first\n\nfiscal year of effectiveness of the bill, after it becomes law, must\n\ninclude funds to pay the amount determined by the actuarial\n\ninvestigation under paragraph 5 of subsection A of Section 3109 of\n\nthis title. It is the intent of the Legislature that future\n\nappropriations for subsequent fiscal years must include an amount\n\nnecessary to maintain the actuarial soundness of the retirement\n\nsystem in accordance with the findings of the actuarial\n\ninvestigation. Any limitation on the rate of employer contributions\n\nthat may be included in a law which is the source of authority for a\n\nretirement system affected by this subsection shall be amended to\n\nthe extent necessary to comply with the requirements of this\n\nsubsection.\n\nC. When a retirement bill having a fiscal impact amends a\n\nretirement system having employer contributions funded wholly or\n\npartially from the funds of a political subdivision, that political\n\nsubdivision shall have a duty to produce funds as necessary to pay\n\nall or its proportionate share of the amount determined by actuarial\n\ninvestigation under paragraph 5 of subsection A of Section 3109 of\n\nthis title.\n\nD. When a retirement bill having a fiscal impact creates a new\n\nretirement system, then employer contributions in conformity with\n\nparagraph 5 of subsection A of Section 3109 of this title must be\n\nmade to the retirement system either by direct appropriations by the\n\nLegislature or by another source of employer contributions\n\nspecifically provided for in the bill creating the new retirement\n\nsystem.","path":["OK Code","Title 62"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os62.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"152266c6e70438d072496bdd3974e67ab59bedb5ecfa6e51a5fdfc5a1ab1fac0","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-62-62-3110","next":"us-ok/okla.-stat.-tit.-62-62-3112"},"notice":"GroundRules: Original legal text.
