There is hereby created the position of Chief Information\n\nOfficer who shall be appointed by the Governor. The Chief\n\nInformation Officer, in addition to having authority over the\n\nInformation Services Division of the Office of Management and\n\nEnterprise Services, shall also serve as Secretary of Information\n\nTechnology and Telecommunications or successor cabinet position and\n\nshall have jurisdictional areas of responsibility related to\n\ninformation technology and telecommunications systems of all state\n\nagencies as provided for in state law. The salary of the Chief\n\nInformation Officer shall not be less than One Hundred Thirty\n\nThousand Dollars ($130,000.00) or more than One Hundred Sixty\n\nThousand Dollars ($160,000.00).\n\nB. Any person appointed to the position of Chief Information\n\nOfficer shall meet the following eligibility requirements:\n\n1. A baccalaureate degree in Computer Information Systems,\n\nInformation Systems or Technology Management, Business\n\nAdministration, Finance, or other similar degree;\n\n2. A minimum of ten (10) years of professional experience with\n\nresponsibilities for management and support of information systems\n\nand information technology, including seven (7) years of direct\n\nmanagement of a major information technology operation;\n\n3. Familiarity with local and wide-area network design,\n\nimplementation, and operation;\n\n4. Experience with data and voice convergence service\n\nofferings;\n\n5. Experience in developing technology budgets;\n\n6. Experience in developing requests for proposal and\n\nadministering the bid process;\n\n7. Experience managing professional staff, teams, and\n\nconsultants;\n\n8. Knowledge of telecommunications operations;\n\n9. Ability to develop and set strategic direction for\n\ninformation technology and telecommunications and to manage daily\n\ndevelopment and operations functions;\n\n10. An effective communicator who is able to build consensus;\n\n11. Ability to analyze and resolve complex issues, both logical\n\nand interpersonal;\n\n12. Effective verbal and written communications skills and\n\neffective presentation skills, geared toward coordination and\n\neducation;\n\n13. Ability to negotiate and defuse conflict; and\n\n14. A self-motivator, independent, cooperative, flexible and\n\ncreative.\n\nC. The salary and any other expenses for the Chief Information\n\nOfficer shall be budgeted as a separate line item through the Office\n\nof Management and Enterprise Services. The operating expenses of\n\nthe Information Services Division shall be set by the Chief\n\nInformation Officer and shall be budgeted as a separate line item\n\nthrough the Office of Management and Enterprise Services. The\n\nOffice of Management and Enterprise Services shall provide adequate\n\noffice space, equipment and support necessary to enable the Chief\n\nInformation Officer to carry out the information technology and\n\ntelecommunications duties and responsibilities of the Chief\n\nInformation Officer and the Information Services Division.\n\nD. 1. Within twelve (12) months of appointment, the first\n\nChief Information Officer shall complete an assessment, which shall\n\nbe modified annually pursuant to Section 35.5 of this title, of the\n\nimplementation of the transfer, coordination, and modernization of\n\nall information technology and telecommunication systems of all\n\nstate agencies in the state as provided for in the Oklahoma\n\nInformation Services Act. The assessment shall include the\n\ninformation technology and telecommunications systems of all\n\ninstitutions within The Oklahoma State System of Higher Education,\n\nthe Oklahoma State Regents for Higher Education and the\n\ntelecommunications network known as OneNet as assembled and\n\nsubmitted by the Oklahoma Higher Education Chief Information\n\nOfficer, as designated by the Oklahoma State Regents for Higher\n\nEducation.\n\n2. Within twelve (12) months of appointment, the first Chief\nystems of all\n\ninstitutions within The Oklahoma State System of Higher Education,\n\nthe Oklahoma State Regents for Higher Education and the\n\ntelecommunications network known as OneNet as assembled and\n\nsubmitted by the Oklahoma Higher Education Chief Information\n\nOfficer, as designated by the Oklahoma State Regents for Higher\n\nEducation.\n\n2. Within twelve (12) months of appointment, the first Chief\n\nInformation Officer shall issue a report setting out a plan of\n\naction which will include the following:\n\na. define the shared service model organization structure\n\nand the reporting relationship of the recommended\n\norganization,\n\nb. the implementation of an information technology and\n\ntelecommunications shared services model that defines\n\nthe statewide infrastructure environment needed by\n\nmost state agencies that is not specific to individual\n\nagencies and the shared applications that are utilized\n\nacross multiple agencies,\n\nc. define the services that shall be in the shared\n\nservices model under the control of the Information\n\nServices Division of the Office of Management and\n\nEnterprise Services,\n\nd. define the roadmap to implement the proposed shared\n\nservices model. The roadmap shall include\n\nrecommendations on the transfer, coordination, and\n\nmodernization of all information technology and\n\ntelecommunication systems of all the state agencies in\n\nthe state,\n\ne. recommendations on the reallocation of information\n\ntechnology and telecommunication resources and\n\npersonnel,\n\nf. a cost benefit analysis to support the recommendations\n\non the reallocation of information technology and\n\ntelecommunication resources and personnel,\n\ng. a calculation of the net savings realized through the\n\nreallocation and consolidation of information\n\ntechnology and telecommunication resources and\n\npersonnel after compensating for the cost of\n\ncontracting with a private consultant as authorized in\n\nparagraph 4 of this subsection, implementing the plan\n\nof action, and ongoing costs of the Information\n\nServices Division of the Office of Management and\n\nEnterprise Services, and\n\nh. the information required in subsection B of Section\n\n35.5 of this title.\n\n3. The plan of action report shall be presented to the\n\nGovernor, Speaker of the Oklahoma House of Representatives, and the\n\nPresident Pro Tempore of the Oklahoma State Senate.\n\n4. The Chief Information Officer may contract with a private\n\nconsultant or consultants to assist in the assessment and\n\ndevelopment of the plan of action report as required in this\n\nsubsection.\n\nE. The Chief Information Officer shall be authorized to employ\n\npersonnel, fix the duties and compensation of the personnel, not\n\notherwise prescribed by law, and otherwise direct the work of the\n\npersonnel in performing the function and accomplishing the purposes\n\nof the Information Services Division of the Office of Management and\n\nEnterprise Services.\n\nF. The Information Services Division of the Office of\n\nManagement and Enterprise Services shall be responsible for the\n\nfollowing duties:\n\n1. Formulate and implement the information technology strategy\n\nfor all state agencies;\n\n2. Define, design, and implement a shared services statewide\n\ninfrastructure and application environment for information\n\ntechnology and telecommunications for all state agencies;\n\n3. Direct the development and operation of a scalable\n\ntelecommunications infrastructure that supports data and voice\n\ncommunications reliability, integrity, and security;\n\n4. Supervise the applications development process for those\n\napplications that are utilized across multiple agencies;\n\n5. Provide direction for the professional development of\n\ninformation technology staff of state agencies and oversee the\n\nprofessional development of the staff of the Information Services\n\nDivision of the Office of Management and Enterprise Services;\n\n6. Evaluate all technology and telecommunication investment\n\nchoices for all state agencies;\nplications that are utilized across multiple agencies;\n\n5. Provide direction for the professional development of\n\ninformation technology staff of state agencies and oversee the\n\nprofessional development of the staff of the Information Services\n\nDivision of the Office of Management and Enterprise Services;\n\n6. Evaluate all technology and telecommunication investment\n\nchoices for all state agencies;\n\n7. Create a plan to ensure alignment of current systems, tools,\n\nand processes with the strategic information technology plan for all\n\nstate agencies;\n\n8. Set direction and provide oversight for the support and\n\ncontinuous upgrading of the current information technology and\n\ntelecommunication infrastructure in the state in support of enhanced\n\nreliability, user service levels, and security;\n\n9. Direct the development, implementation, and management of\n\nappropriate standards, policies and procedures to ensure the success\n\nof state information technology and telecommunication initiatives;\n\n10. Recruit, hire and transfer the required technical staff in\n\nthe Information Services Division of the Office of Management and\n\nEnterprise Services to support the services provided by the Division\n\nand the execution of the strategic information technology plan;\n\n11. Establish, maintain, and enforce information technology and\n\ntelecommunication standards;\n\n12. Delegate, coordinate, and review all work to ensure quality\n\nand efficient operation of the Information Services Division of the\n\nOffice of Management and Enterprise Services;\n\n13. Create and implement a communication plan that disseminates\n\npertinent information to state agencies on standards, policies,\n\nprocedures, service levels, project status, and other important\n\ninformation to customers of the Information Services Division of the\n\nOffice of Management and Enterprise Services and provide for agency\n\nfeedback and performance evaluation by customers of the Division;\n\n14. Develop and implement training programs for state agencies\n\nusing the shared services of the Information Services Division of\n\nthe Office of Management and Enterprise Services and recommend\n\ntraining programs to state agencies on information technology and\n\ntelecommunication systems, products and procedures;\n\n15. Provide counseling, performance evaluation, training,\n\nmotivation, discipline, and assign duties for employees of the\n\nInformation Services Division of the Office of Management and\n\nEnterprise Services;\n\n16. For all state agencies, approve the purchasing of all\n\ninformation technology and telecommunication services and approve\n\nthe purchase of any information technology and telecommunication\n\nproduct except the following:\n\na. a purchase less than or equal to Five Thousand Dollars\n\n($5,000.00) if such product is purchased using a state\n\npurchase card and the product is listed on either the\n\nApproved Hardware or Approved Software list located on\n\nthe Office of Management and Enterprise Services\n\nwebsite, or\n\nb. a purchase over Five Thousand Dollars ($5,000.00) and\n\nless than or equal to Twenty-five Thousand Dollars\n\n($25,000.00) if such product is purchased using a\n\nstate purchase card, the product is listed on an\n\ninformation technology or telecommunications statewide\n\ncontract, and the product is listed on either the\n\nApproved Hardware or Approved Software list located on\n\nthe Office of Management and Enterprise Services\n\nwebsite;\n\n17. Develop and enforce an overall infrastructure architecture\n\nstrategy and associated roadmaps for desktop, network, server,\n\nstorage, and statewide management systems for state agencies;\n\n18. Effectively manage the design, implementation and support\n\nof complex, highly available infrastructure to ensure optimal\n\nperformance, on-time delivery of features, and new products, and\n\nscalable growth;\n\n19. Define and implement a governance model for requesting\nure\n\nstrategy and associated roadmaps for desktop, network, server,\n\nstorage, and statewide management systems for state agencies;\n\n18. Effectively manage the design, implementation and support\n\nof complex, highly available infrastructure to ensure optimal\n\nperformance, on-time delivery of features, and new products, and\n\nscalable growth;\n\n19. Define and implement a governance model for requesting\n\nservices and monitoring service level metrics for all shared\n\nservices; and\n\n20. Create the budget for the Information Services Division of\n\nthe Office of Management and Enterprise Services to be submitted to\n\nthe Legislature each year.\n\nG. The State Governmental Technology Applications Review Board\n\nshall provide ongoing oversight of the implementation of the plan of\n\naction required in subsection D of this section. Any proposed\n\namendments to the plan of action shall be approved by the Board\n\nprior to adoption.\n\nH. 1. The Chief Information Officer shall act as the\n\nInformation Technology and Telecommunications Purchasing Director\n\nfor all state agencies and shall be responsible for the procurement\n\nof all information technology and telecommunication software,\n\nhardware, equipment, peripheral devices, maintenance, consulting\n\nservices, high technology systems, and other related information\n\ntechnology, data processing, telecommunication and related\n\nperipherals and services for all state agencies. The Chief\n\nInformation Officer shall establish, implement, and enforce policies\n\nand procedures for the procurement of information technology and\n\ntelecommunication software, hardware, equipment, peripheral devices,\n\nmaintenance, consulting services, high technology systems, and other\n\nrelated information technology, data processing, telecommunication\n\nand related peripherals and services by purchase, lease-purchase,\n\nlease with option to purchase, lease and rental for all state\n\nagencies. The procurement policies and procedures established by\n\nthe Chief Information Officer shall be consistent with The Oklahoma\n\nCentral Purchasing Act.\n\n2. The Chief Information Officer, or any employee or agent of\n\nthe Chief Information Officer acting within the scope of delegated\n\nauthority, shall have the same power and authority regarding the\n\nprocurement of all information technology and telecommunication\n\nproducts and services as outlined in paragraph 1 of this subsection\n\nfor all state agencies as the State Purchasing Director has for all\n\nacquisitions used or consumed by state agencies as established in\n\nThe Oklahoma Central Purchasing Act. Such authority shall,\n\nconsistent with the authority granted to the State Purchasing\n\nDirector pursuant to Section 85.10 of Title 74 of the Oklahoma\n\nStatutes, include the power to designate financial or proprietary\n\ninformation submitted by a bidder confidential and reject all\n\nrequests to disclose the information so designated, if the Chief\n\nInformation Officer requires the bidder to submit the financial or\n\nproprietary information with a bid, proposal, or quotation.\n\nI. The Information Services Division of the Office of\n\nManagement and Enterprise Services and the Chief Information Officer\n\nshall be subject to the Oklahoma Central Purchasing Act for the\n\napproval and purchase of all equipment, products, and services and\n\nshall also be subject to the requirements of the Public Competitive\n\nBidding Act of 1974, the Oklahoma Lighting Energy Conservation Act\n\nand the Public Building Construction and Planning Act. The Chief\n\nInformation Officer shall be authorized to delegate all or some of\n\nthe procurement of information technology and telecommunication\n\nproducts and services and construction of facilities and\n\ntelecommunication networks to another state entity if the Chief\n\nInformation Officer determines it to be cost-effective and in the\n\nbest interest of the state. The Chief Information Officer shall\n\nhave authority to designate information technology and\ndelegate all or some of\n\nthe procurement of information technology and telecommunication\n\nproducts and services and construction of facilities and\n\ntelecommunication networks to another state entity if the Chief\n\nInformation Officer determines it to be cost-effective and in the\n\nbest interest of the state. The Chief Information Officer shall\n\nhave authority to designate information technology and\n\ntelecommunication contracts as statewide contracts and mandatory\n\nstatewide contracts pursuant to Section 85.5 of Title 74 of the\n\nOklahoma Statutes and to negotiate consolidation contracts,\n\nenterprise agreements and high technology systems contracts. Any\n\ncontract entered into by a state agency for which the Chief\n\nInformation Officer has not acted as the Information Technology and\n\nTelecommunications Purchasing Director as required in this\n\nsubsection or subsection H of this section, shall be deemed to be\n\nunenforceable and the Office of Management and Enterprise Services\n\nshall not process any claim associated with the provisions thereof.\n\nJ. The Chief Information Officer shall establish, implement,\n\nand enforce policies and procedure for the development and\n\nprocurement of an interoperable radio communications system for\n\nstate agencies. The Chief Information Officer shall work with local\n\ngovernmental entities in developing the interoperable radio\n\ncommunications system.\n\nK. The Chief Information Officer shall develop and implement a\n\nplan to utilize open source technology and products for the\n\ninformation technology and telecommunication systems of all state\n\nagencies.\n\nL. All state agencies and authorities of this state and all\n\nofficers and employees of those entities shall work and cooperate\n\nwith and lend assistance to the Chief Information Officer and the\n\nInformation Services Division of the Office of Management and\n\nEnterprise Services and provide any and all information requested by\n\nthe Chief Information Officer.\n\nM. The Chief Information Officer shall prepare an annual report\n\ndetailing the ongoing net saving attributable to the reallocation\n\nand consolidation of information technology and telecommunication\n\nresources and personnel and shall submit the report to the Governor,\n\nthe Speaker of the Oklahoma House of Representatives, and the\n\nPresident Pro Tempore of the Oklahoma State Senate.\n\nN. For purposes of the Oklahoma Information Services Act,\n\nunless otherwise provided for, \"state agencies\" shall include any\n\noffice, officer, bureau, board, commission, counsel, unit, division,\n\nbody, authority or institution of the executive branch of state\n\ngovernment, whether elected or appointed; provided, except with\n\nrespect to the provisions of subsection D of this section, the term\n\n\"state agencies\" shall not include institutions within The Oklahoma\n\nState System of Higher Education, the Oklahoma State Regents for\n\nHigher Education and the telecommunications network known as OneNet.\n\nO. As used in this section:\n\n1. \"High technology system\" means advanced technological\n\nequipment, software, communication lines, and services for the\n\nprocessing, storing, and retrieval of information by a state agency;\n\n2. \"Consolidation contract\" means a contract for several state\n\nor public agencies for the purpose of purchasing information\n\ntechnology and telecommunication goods and services; and\n\n3. \"Enterprise agreement\" means an agreement for information\n\ntechnology or telecommunication goods and services with a supplier\n\nwho manufactures, develops and designs products and provides\n\nservices that are used by one or more state agencies.","path":["OK Code","Title 62"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os62.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"16a4e4dd564f0c879f66f9fb7deac1c5389fe189e88405558c952fc96a5ff8d2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-62-62-34.11","next":"us-ok/okla.-stat.-tit.-62-62-34.11.1.1"},"notice":"GroundRules: Original legal text.
