Stat. tit. 62, § 62-34.210","heading":"Managing state data by state agencies – Standards and","body":"criteria for sharing data between agencies.\n\nA. As used in this section, \"state data\" means all data files\n\nhosted, procured, owned, processed, secured, stored, or created by\n\nthis state or its state agencies, while in the course of state\n\nbusiness and shall include any and all data not otherwise prohibited\n\nfrom such classification or required to be kept confidential by\n\nstate or federal law. Such data shall be the property of this state\n\nunless prohibited by law.\n\nB. While this state is the owner of state data, individual\n\nstate agencies shall comply with their respective statutory\n\nobligations in managing state data including responding to open\n\nrecords requests, reporting and responding to data breaches, and any\n\nother statutory obligations required when hosting, accessing,\n\nstoring, collecting, or processing state data.\n\nC. The Chief Information Officer for the State of Oklahoma may\n\nestablish standards and criteria for sharing state data between\n\nstate agencies. Agency requests to share state data shall be denied\n\nif the stated purpose does not meet the established standards and\n\ncriteria for sharing state data as established by the CIO. State\n\nagencies may decline requests to share state data if the state data\n\nrequested is otherwise privileged, required to be kept confidential,\n\nor prohibited from being shared by state or federal law.\n\nD. The powers provided in this section shall be in addition to\n\nand not in substitution for any powers provided to the Office of\n\nManagement and Enterprise Services or the Chief Information Officer\n\nby rule or law.\n\nE. No powers provided in this section shall exempt or supersede\n\na state agency's statutory responsibility to protect data and to\n\ncomply with requirements of the Oklahoma Open Records Act or\n\napplicable state or federal law.\n\nF.
