Stat. tit. 62, § 62-34.28","heading":"Accessibility of information technology for individuals","body":"with disabilities – Undue burden – Rules.\n\nA. The Information Services Division of the Office of\n\nManagement and Enterprise Services shall work to assure state\n\ncompliance regarding accessibility of information technology for\n\nindividuals with disabilities based on the provisions of Section 508\n\nof the Workforce Investment Act of 1998.\n\nB. When developing, procuring, maintaining or using information\n\ntechnology, or when administering contracts or grants that include\n\nthe procurement, development, upgrading, or replacement of\n\ninformation technology each state agency shall ensure, unless an\n\nundue burden would be imposed on the agency, that the information\n\ntechnology allows employees, program participants, and members of\n\nthe general public access to use of information and data that is\n\ncomparable to the access by individuals without disabilities.\n\nC. To assure accessibility, the Information Services Division\n\nshall:\n\n1. Adopt accessibility standards that address all technical\n\nstandard categories of Section 508 of the Workforce Investment Act\n\nof 1998 to be used by each state agency in the procurement of\n\ninformation technology, and in the development and implementation of\n\ncustom-designed information technology systems, Web sites, and other\n\nemerging information technology systems;\n\n2. Adopt an accessibility clause which shall be included in all\n\ncontracts for the procurement of information technology by or for\n\nthe use of state agencies;\n\n3. Establish and implement a review procedure to be used to\n\nevaluate the accessibility of custom-designed information technology\n\nsystems proposed by a state agency prior to expenditure of state\n\nfunds;\n\n4. Review and evaluate accessibility of information technology\n\ncommonly purchased by state agencies, and provide accessibility\n\nreports on such products to those responsible for purchasing\n\ndecisions;\n\n5. Provide in partnership with Oklahoma Able Tech, the state\n\nassistive technology program located at Oklahoma State University,\n\ntraining and technical assistance for state agencies to assure\n\nprocurement of information technology that meets adopted\n\naccessibility standards;\n\n6. Consult with the State Department of Rehabilitation Services\n\nand individuals with disabilities in accessibility reviews of\n\ninformation technology and in the delivery of training and technical\n\nassistance;\n\n7. Establish complaint procedures, consistent with Section 508\n\nof the Workforce Development Act of 1998, to be used by an\n\nindividual who alleges that a state agency fails to comply with the\n\nprovisions of this section;\n\n8. Work with and seek advice from the Electronic and\n\nInformation Technology Accessibility Advisory Council, created in\n\nSection 34.30 of this title in developing accessibility standards\n\nand complaint procedures as required in this section; and\n\n9. Require state agencies to submit evidence of assurance of\n\ncompliance with state standards on accessibility of information\n\ntechnology for individuals with disabilities developed in accordance\n\nwith this section.\n\nD.
