The administrative head of any agency or the request officer\n\nmay request that any current item of appropriation, allotment, or\n\nbudget category be transferred to any other budget category within\n\nthe same agency.\n\nB. The administrative head shall make a request for budget\n\ntransfer to the Director of the Office of Management and Enterprise\n\nServices in writing and file a revised agency budget.\n\nC. Copies of the request for budget transfer and corresponding\n\nagency budget revisions shall also be filed with the Joint\n\nLegislative Committee on Budget and Program Oversight as created by\n\nSection 34.96 of this title.\n\nD. The Director of the Office of Management and Enterprise\n\nServices shall approve the request for transfer unless both the\n\nChair and Vice Chair of the Joint Legislative Committee on Budget\n\nand Program Oversight provide written notification to the Director\n\nof the Office of Management and Enterprise Services within twelve\n\n(12) calendar days of receipt of transfer request that the transfer\n\nsubverts the intention and objectives of the Legislature in\n\nestablishing the original appropriation, or unless the transfer does\n\nnot meet the requirements of this section or Section 34.49 of this\n\ntitle. Notification of noncompliance with legislative intent shall\n\nbe transmitted to the Director of the Office of Management and\n\nEnterprise Services within twelve (12) calendar days of receipt of\n\nthe transfer request. The Director of the Office of Management and\n\nEnterprise Services shall give written notice of approval or\n\ndisapproval of each budget transfer to the agency, the Governor and\n\nthe Chair and Vice Chair of the Joint Legislative Committee on\n\nBudget and Program Oversight within eighteen (18) calendar days of\n\nreceiving the request.\n\nE. Transfers shall be subject to the following limitations:\n\n1. The amount to be transferred, together with all previous\n\ntransfers, shall not exceed twenty-five percent (25%) of the total\n\nappropriation of the least of the items of appropriation, allotment\n\nor agency budget involved in the transfer; and\n\n2. If the amount to be transferred, and all previous transfers,\n\nis greater than twenty-five percent (25%) of the least items of\n\nappropriation, allotment or agency budget involved in the transfer\n\nrequest, the agency may make an application to the Director of the\n\nOffice of Management and Enterprise Services, and the Chair and Vice\n\nChair of the Joint Legislative Committee on Budget and Program\n\nOversight.
