There is hereby re-created, to continue until July 1, 2008,\n\nin accordance with the provisions of the Oklahoma Sunset Law, a\n\nSpecial Agency Account Board, to consist of the Director of the\n\nOffice of Management and Enterprise Services, the State Treasurer\n\nand the Director of the Legislative Service Bureau. The Board shall\n\nhave the authority to approve the establishment of agency special\n\naccounts in the official depository of the State Treasury. In the\n\ncase of institutions of higher education, the Special Agency Account\n\nBoard, acting in conjunction with the Oklahoma State Regents for\n\nHigher Education, shall establish special agency accounts as\n\nappropriate which shall be consistent with provisions of the\n\nOklahoma State Finance Act, as it relates to institutions in The\n\nOklahoma State System of Higher Education.\n\nB. The Board, created by this section, shall adopt procedures\n\nincluding application forms, justification and other pertinent\n\ninformation as to the basis for a state agency application for the\n\nestablishment of agency special accounts.\n\nC. The Board may approve agency special accounts for money\n\nreceived by state agencies for the following purposes:\n\n1. Benefit programs for individuals, including, but not limited\n\nto, unemployment compensation, workers' compensation and state\n\nretirement programs;\n\n2. Revenues produced by activities or facilities ancillary to\n\nthe operation of a state agency which receive no money, directly or\n\nindirectly, from or through that state agency, including, but not\n\nlimited to, revenues from the sales of food at retail level, sales\n\nat canteens, sales at student unions, sales at student bookstores,\n\nreceipts from athletic programs and receipts from housing.\n\nProvided, however, that a state institution of higher learning may\n\npurchase necessary equipment and instructional supplies and office\n\nsupplies from a student bookstore, or, subject to authorization by\n\nthe Oklahoma State Regents for Higher Education, may rent building\n\nspace for institutional use in a building operated by an\n\norganization or entity whose existence is ancillary to the operation\n\nof a state agency, and whose cost was financed in whole or in part\n\nwith revenue-type bonds; provided, further, that the cost of such\n\noffice supplies or space rental shall not exceed the cost of similar\n\nsupplies or rentals available commercially;\n\n3. Gifts, devises and bequests with an agency as beneficiary,\n\nunless otherwise provided by statute;\n\n4. Evidence funds for law enforcement agencies;\n\n5. Student loan funds and scholarship funds;\n\n6. Funds held in escrow;\n\n7. Land Commission funds;\n\n8. Funds for which the state agency acts as custodian,\n\nincluding, but not limited to, fees from employee earnings approved\n\nby the governing board of the agency, funds of student organizations\n\nincluding student activity fees collected by an educational\n\ninstitution as a separate item in enrollment procedures,\n\nprofessional organizations, patients and inmates;\n\n9. Funds used by the Oklahoma Tax Commission to pay for the\n\nfiling of liens with the Federal Aviation Administration;\n\n10. Temporary accounts for funds arising from new or amended\n\nlegislation not otherwise provided for in statute or for other\n\nemergency situations. Such accounts are to be utilized only pending\n\nlegislative action directing custody of such funds;\n\n11. Payment of liability claims against the state;\n\n12. Activities of the various Armory Boards of the Oklahoma\n\nMilitary Department to receive and dispense funds derived by the\n\nArmory Boards pursuant to Sections 232.6 and 232.7 of Title 44 of\n\nthe Oklahoma Statutes; and\n\n13. Payment of expenses incurred in connection with the\n\nacceptance of payments made with nationally recognized credit cards.\n\nD. The State Treasurer is authorized to accept deposit of money\nary Department to receive and dispense funds derived by the\n\nArmory Boards pursuant to Sections 232.6 and 232.7 of Title 44 of\n\nthe Oklahoma Statutes; and\n\n13. Payment of expenses incurred in connection with the\n\nacceptance of payments made with nationally recognized credit cards.\n\nD. The State Treasurer is authorized to accept deposit of money\n\nmade directly to agency special accounts approved by the Board. All\n\nmoney received by a state agency, as described in Section 34.57 of\n\nthis title, shall be deposited in State Treasury funds or accounts\n\nand no money shall be deposited in banks or other depositories\n\nunless the bank accounts are maintained by the State Treasurer or\n\nare for the deposit of authorized petty cash funds.\n\nE. Money deposited in agency special accounts shall be\n\ndisbursed on vouchers issued by the state agency concerned to\n\naccomplish the purpose for which the money was intended.\n\nF. Funds and revenues of the Grand River Dam Authority are\n\nexempt from the requirements of this section.\n\nG. Funds and revenues of the Oklahoma Municipal Power Authority\n\nare exempt from the requirements of this section.\n\nH. Monies used for investment purposes by the Oklahoma\n\nFirefighters Pension and Retirement System, the Oklahoma Police\n\nPension and Retirement System, the Uniform Retirement System for\n\nJustices and Judges, the Oklahoma Law Enforcement Retirement System,\n\nthe Oklahoma Public Employees Retirement System, the Teachers'\n\nRetirement System of Oklahoma, the State Insurance Fund, the\n\nOklahoma Employees Insurance and Benefits Board, the Commissioners\n\nof the Land Office, and the Oklahoma State Regents for Higher\n\nEducation for its Endowment Trust Fund are exempt from the\n\nrequirements of this section, and shall be placed with the\n\nrespective custodian bank or trust company.","path":["OK Code","Title 62"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os62.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a824a7bed951685c76553f24db63fd8c1175bf39e0d51c6fb5a749aec2b844ad","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-62-62-34.55","next":"us-ok/okla.-stat.-tit.-62-62-34.57"},"notice":"GroundRules: Original legal text.
