Stat. tit. 62, § 62-35.5","heading":"Integral information technology assets - Information","body":"technology positions - Assessment.\n\nA. 1. All state agencies shall provide to the Chief\n\nInformation Officer a list of information technology assets of the\n\nagency which are integral to agency-specific applications or\n\nfunctions and a list of information technology positions which are\n\ndirectly associated with the assets. The agency shall further\n\nprovide the reference to federal or state statutory or\n\nconstitutional provisions which require it to perform the\n\napplications or functions.\n\n2. If the Chief Information Officer disputes the identification\n\nof assets or positions provided by a state agency as being integral\n\nto agency-specific applications or functions, the Director of the\n\nOffice of Management and Enterprise Services shall make the final\n\ndetermination.\n\nB. Not later than December 1 of each year, the Chief\n\nInformation Officer shall modify the assessment required by\n\nsubsection D of Section 34.11.1 of this title to include\n\nidentification of:\n\n1. All information technology assets of all state agencies,\n\nwhich are not integral to agency-specific applications or functions,\n\nand the transfer of which to the Information Services Division of\n\nthe Office of Management and Enterprise Services and the Chief\n\nInformation Officer would result in a cost savings to the taxpayers\n\nof this state or improved efficiency of state government operations,\n\nincluding all furniture, equipment, vehicles, supplies, records,\n\ncurrent and future liabilities, fund balances, encumbrances,\n\nobligations, and indebtedness associated with the information\n\ntechnology assets;\n\n2. All information technology positions associated with the\n\ninformation technology assets identified pursuant to paragraph 1 of\n\nthis subsection. The assessment shall identify the amount of\n\ncompensation and related liabilities for accrued sick leave, annual\n\nleave, holidays, unemployment benefits, and workers' compensation\n\nbenefits for the positions;\n\n3. The amount of savings to the taxpayers of this state\n\nresulting from the provisions of the Information Technology\n\nConsolidation and Coordination Act; and\n\n4. Any changes in law required or any changes to the amount of\n\nstate appropriations or other state funds associated with the\n\ntransfer of the information technology assets or positions.\n\nC. The information technology assets and positions of each\n\nappropriated state agency identified pursuant to this section shall\n\nbe transferred as part of the consolidation of information\n\ntechnology operations of the state agency to the Information\n\nServices Division of the Office of Management and Enterprise\n\nServices when determined by the Information Services Division. The\n\ncosts of operation, maintenance, licensing and service of the\n\ninformation technology assets shall remain the responsibility of the\n\nstate agency from which the assets are transferred until the state\n\nagency information technology operations are consolidated in the\n\nInformation Services Division, unless otherwise agreed to by the\n\nstate agency and the Information Services Division. Appropriate\n\nconveyances and other documents shall be executed to effectuate the\n\ntransfer of the information technology assets and positions to the\n\nInformation Services Division of the Office of Management and\n\nEnterprise Services.\n\nD. The Chief Information Officer shall recommend changes to the\n\nDirector of the Office of Management and Enterprise Services and the\n\nGovernor for inclusion in the next executive budget to be submitted\n\nto the Legislature.\n\nE. The Information Services Division shall provide shared\n\nservices to each state agency and shall bill agencies for those\n\nshared services at an estimated cost to provide the services. The\n\nestimated cost shall include the full cost of the services,\n\nincluding materials, depreciation related to capital costs, labor,\n\nand administrative expenses of the Information Services Division of\negislature.\n\nE. The Information Services Division shall provide shared\n\nservices to each state agency and shall bill agencies for those\n\nshared services at an estimated cost to provide the services. The\n\nestimated cost shall include the full cost of the services,\n\nincluding materials, depreciation related to capital costs, labor,\n\nand administrative expenses of the Information Services Division of\n\nthe Office of Management and Enterprise Services in connection with\n\nthe operation of the data center and Information Services Division\n\noperations and shall include expenses associated with acquiring,\n\ninstalling, and operating information technology and\n\ntelecommunications infrastructure, hardware and software for use by\n\nstate agencies. The Information Services Division shall publish a\n\nschedule of costs for each available shared service and shall enter\n\ninto an agreement with each state agency for the shared services\n\nthat will be provided to the agency. The aggregated cost of shared\n\nservices to be provided to each state agency shall be budgeted\n\nannually as a separate line item through each state agency. State\n\nagencies shall process request for payments as provided for under\n\nthe agreement entered into with the Information Services Division in\n\na timely manner. If payments are deemed to be delinquent for shared\n\nservices provided to a state agency, the Information Services\n\nDivision may request the Division of Central Accounting and\n\nReporting of the Office of Management and Enterprise Services to\n\ncreate vouchers and process payments to the Information Services\n\nDivision against the funds of the delinquent state agency. If the\n\nstate agency for which shared services were provided disputes the\n\nprovision of shared services in accordance with its agreement with\n\nthe Information Services Division, no voucher shall be processed\n\nagainst the funds of the delinquent agency until the dispute over\n\nservices has been resolved, at which point a voucher may be\n\nprocessed in accordance with the terms of the dispute resolution.\n\nF. The Information Services Division of the Office of\n\nManagement and Enterprise Services shall succeed to any contractual\n\nrights, easement rights, lease rights, and other similar rights and\n\nresponsibilities related to the information technology assets that\n\nare transferred as provided for in this section and incurred by an\n\nappropriated state agency.","path":["OK Code","Title 62"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os62.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5e9bb508353b443f80591331749dc02fcd11e8e6d5a281fe600d40a05c6d8754","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-62-62-35.4","next":"us-ok/okla.-stat.-tit.-62-62-35.6"},"notice":"GroundRules: Original legal text.
