A state agency may apply to the Chief Information Officer\n\nfor an exemption from any provisions of the Information Technology\n\nConsolidation and Coordination Act or for an extension of any\n\ndeadline specified in the Act, if it determines that compliance with\n\nthe provisions of the Act would:\n\n1. Cause it to be in violation of federal law or regulations or\n\nin violation of any provision of the Oklahoma Constitution or\n\nstatutes;\n\n2. Result in a loss of federal funds to the state; or\n\n3. Create an impediment to the performance of a unique agency\n\nfunction that is not duplicated by another state agency and is\n\nrequired by the Oklahoma Statutes or Constitution or by federal law.\n\nB. Any state agency applying for an exemption or extension\n\npursuant to this section shall provide written documentation of the\n\ncircumstances to the Chief Information Officer. After reviewing the\n\ndocumentation, the Chief Information Officer shall grant or deny the\n\napplication.
