Except as otherwise provided by the Information Technology\n\nConsolidation and Coordination Act, any state agency may employ\n\ninformation technology personnel to develop and implement the\n\nagency’s technology strategy, provided that the agency remains\n\nsubject to the standards, policies, and oversight established by the\n\nChief Information Officer of this state for the purposes of data\n\nintegrity and security.\n\nB. A state agency may employ information technology personnel\n\npursuant to this section if it first enters into a memorandum of\n\nunderstanding with the Chief Information Officer detailing, at a\n\nminimum:\n\n1. The specific positions and job descriptions that the agency\n\nplans to hire;\n\n2. The qualifications of the positions;\n\n3. Agreement by the state agency to be bound by the standards,\n\npolicies, and oversight set forth by the Chief Information Officer\n\nfor security and data integrity purposes; and\n\n4. Any other terms deemed necessary by the Chief Information\n\nOfficer or the state agency.\n\nNo information technology personnel shall be hired or retained\n\nby the state agency until a memorandum of understanding has been\n\nfully executed by both the Chief Information Officer and the state\n\nagency.\n\nC. The Chief Information Officer, at his or her discretion, may\n\naudit the state agency’s compliance with the provisions of the\n\nmemorandum of understanding and any other requirements of this\n\nsection.\n\nD.
