Notwithstanding any other provision of law, the provisions\n\nof the Information Technology Consolidation and Coordination Act\n\nshall operate to maintain or increase security standards and shall\n\nnot jeopardize confidentiality or compliance with state or federal\n\nlaws or regulations. The State Governmental Technology Applications\n\nReview Board shall consider and approve security protocols which\n\nshall be followed by employees of the Information Services Division\n\nof the Office of Management and Enterprise Services who are assigned\n\nto service law enforcement agencies. The Board shall make\n\nrecommendations to state officers and employees related to\n\ncontinuity of criminal justice information system security\n\nprotocols.\n\nB. Notwithstanding the provisions of Section 35.5 of this\n\ntitle, the transfer of information technology assets and positions\n\nof the Department of Public Safety shall occur prior to the transfer\n\nof assets and positions of other public safety agencies.\n\nC. Unless otherwise provided for in law, the transfer of\n\ninformation technology assets and positions of any state agency\n\npursuant to the Information Technology Consolidation and\n\nCoordination Act shall not act to transfer to the Information\n\nServices Division of the Office of Management and Enterprise\n\nServices or to the Chief Information Officer the duties of a state\n\nagency to keep, maintain and open to any person all records of the\n\nagency in compliance with the Oklahoma Open Records Act. Each state\n\nagency shall continue to be responsible for records created by,\n\nreceived by, under the authority of, or coming into the custody,\n\ncontrol or possession of the agency including the duty to organize\n\nand categorize the records in a retrievable form and the duty to\n\nrespond to requests for records, even if the records have been\n\ntransmitted to or stored by the Information Services Division of the\n\nOffice of Management and Enterprise Services or the Chief\n\nInformation Officer.\n\nD. State employees who are members of the Teachers' Retirement\n\nSystem of Oklahoma and are transferred pursuant to the Information\n\nTechnology Consolidation and Coordination Act may elect to continue\n\ntheir participation in the Teachers' Retirement System of Oklahoma\n\nin lieu of participating in the Oklahoma Public Employees Retirement\n\nSystem. Any transferred employee who wishes to make such election\n\nshall do so in writing within thirty (30) days of the effective date\n\nof this act. If any transferred employee has already started\n\nparticipating in the Oklahoma Public Employees Retirement System,\n\nthe employee may make an election to return to the Teachers'\n\nRetirement System of Oklahoma if the election is made in writing\n\nwithin thirty (30) days of the effective date of this act. In the\n\nevent a transferred employee who has already begun participating in\n\nthe Oklahoma Public Employees Retirement System elects to return to\n\nthe Teachers' Retirement System of Oklahoma, the Oklahoma Public\n\nEmployees Retirement System shall transfer the service credit and\n\ncontributions to the Teachers' Retirement System of Oklahoma for any\n\ncredit that accrued after the initial transfer.
