Stat. tit. 62, § 62-362","heading":"Proof as to indebtedness before judgment - Appeals","body":"Before final judgment in any suit based on contract, including\n\nbut not limited to proceedings by the Commissioners of the Land\n\nOffice to collect deficient payments plus interest and reasonable\n\nattorney fees related to bonds or other types of indebtedness\n\nguaranteed by the corpus of the permanent school fund for the\n\nsupport of common schools pursuant to Section 10 of this act, shall\n\nbe rendered against any municipality by any court of any county in\n\nthe State of Oklahoma, except in proceedings to refund any\n\nindebtedness of said municipality, proof shall be made to the court,\n\nof the existence, character and amount of the outstanding legal\n\nindebtedness of said municipality, which proof shall include a\n\nstatement compiled by the various officers having custody of the\n\nrecords from which the information required in the statement is\n\ntaken, under oath, showing the following:\n\n1. An itemized statement of the bonded indebtedness of said\n\nmunicipality.\n\n2. An itemized statement of the legal indebtedness of said\n\nmunicipality, exclusive of the bonded indebtedness and the alleged\n\nindebtedness proposed to be converted into a judgment.\n\n3. An itemized statement of the indebtedness proposed to be\n\nconverted into a judgment, so classified as to show, in separate\n\nexhibits, all items of questionable legality, if any, and the\n\nreasons of said officer or officers therefor:\n\n(a.) The appropriations against which each warrant was drawn or\n\nclaim accrued if in judgment, and if within the limits and purposes\n\nthereof as provided by law;\n\n(b.) The income and revenue provided for the respective years,\n\nconsisting of taxes levied and the actual collections of \"estimated\n\nincome\"; the total warrants issued against the same or the\n\naccumulated accruals as the case may be, and the amount, if any, in\n\nexcess of the total income and revenue of the year;\n\n(c.) The condition of each fund from which such indebtedness is\n\npayable as of the close of the month next preceding the filing of\n\napplication.\n\nAppeals from the judgment of the court shall be allowed as\n\nprovided by law upon the giving of a bond for cost and damages in\n\nsuch sum as the court shall require; provided, that the county\n\nattorney of any county may, without the consent of the board of\n\ncounty commissioners of said county, take an appeal from said\n\njudgment on behalf of said county and without bond for costs and\n\ndamages.","path":["OK Code","Title 62"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os62.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e53c3367d9f3b0750a587ca571465dd5c15db32ec439a38ba4cbe6cf1bd0fc3e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-62-62-361","next":"us-ok/okla.-stat.-tit.-62-62-363"},"notice":"GroundRules: Original legal text.
