Stat. tit. 62, § 62-445","heading":"Surplus of sinking fund - Transfer to general fund","body":"Where any county, city, town, or school district, dependent or\n\nindependent, has accumulated a surplus in the sinking fund thereof,\n\nrepresented by actual cash on hand in excess of all outstanding bond\n\nor judgment indebtedness, both matured and unmatured, including\n\ncoupon and/or other interest earnings thereon whether matured or\n\nunmatured, earned or unearned, or if there be no known bond, coupon,\n\nor judgment indebtedness outstanding against it, the county excise\n\nboard on application of the proper officers thereof is hereby\n\nauthorized to approve the transfer of said surplus in the sinking\n\nfund of said county, city, town, or school district to be used for\n\ngeneral fund purposes of the same county, city, town, or school\n\ndistrict; provided, that before the excise board shall have\n\nauthority to consider or approve the application of the governing\n\nboard for authority to make such transfer, there shall be attached\n\nto such application an affidavit and proof of publication of\n\npublished notice by such governing board of its intention to apply\n\nfor authority to make such transfer, which published notice shall\n\nset forth in detail the condition of the sinking fund thereof or as\n\nto the fact of there being no known bond, coupon or judgment\n\nindebtedness outstanding.
