Stat. tit. 62, § 62-45.9","heading":"Schedule of program evaluation and performance review of","body":"state agencies – Duties of Joint Legislative Committee on Budget and\n\nProgram Oversight – Required elements of review - Reports.\n\nA. The Joint Legislative Committee on Budget and Program\n\nOversight shall annually establish a schedule of program evaluation\n\nand performance review for state agencies. In establishing this\n\nschedule the Joint Legislative Committee on Budget and Program\n\nOversight shall take into consideration the work plan of studies,\n\nprogram evaluations and other related performance reviews developed\n\nby the Joint Committee on Accountability in Government. Where\n\nappropriate, the Joint Legislative Committee on Budget and Program\n\nOversight shall coordinate its schedule with related work plan items\n\nof the Joint Accountability in Government Committee.\n\nThe Joint Legislative Committee on Budget and Program Oversight\n\nmay request the Joint Committee on Accountability in Government to\n\ninclude additional evaluations or reviews to their schedule or\n\nexpand any scheduled evaluation or review to include issues of\n\ninterest to the Joint Legislative Committee on Budget and Program\n\nOversight.\n\nThe Joint Legislative Committee on Budget and Program Oversight\n\nmay request any assistance necessary from the Office of the State\n\nAuditor and Inspector in regard to program evaluations or\n\nperformance reviews scheduled by the Committee.\n\nB. The program evaluation and justification review shall be\n\nconducted on major programs, but may include other programs. The\n\nreview shall be comprehensive in its scope but, at a minimum, must\n\nbe conducted in such a manner as to specifically determine the\n\nfollowing, and to consider and determine what changes, if any, are\n\nneeded with respect thereto:\n\n1. The specific purpose of each program, as well as the\n\nspecific public benefit derived therefrom;\n\n2. The progress toward achieving the outputs and outcomes\n\nassociated with each program;\n\n3. An explanation of circumstances contributing to the state\n\nagency's ability to achieve, not achieve, or exceed its projected\n\noutputs and outcomes associated with each program;\n\n4. The identifiable cost of each program;\n\n5. Alternate courses of action that would result in\n\nadministration of the same program in a more efficient or effective\n\nmanner. The courses of action to be considered must include, but\n\nare not limited to:\n\na. whether the program could be organized in a more\n\nefficient and effective manner, whether the program's\n\nmission, goals, or objectives should be redefined, or,\n\nwhen the state agency cannot demonstrate that its\n\nefforts have had a positive effect, whether the\n\nprogram should be reduced in size or eliminated,\n\nb. whether the program could be administered more\n\nefficiently or effectively to avoid duplication of\n\nactivities and ensure that activities are adequately\n\ncoordinated,\n\nc. whether the program could be performed more\n\nefficiently or more effectively by another unit of\n\ngovernment, including political subdivisions of the\n\nstate, or a private entity, or whether a program\n\nperformed by a private entity could be performed more\n\nefficiently and effectively by a state agency,\n\nd. when compared to costs, whether effectiveness warrants\n\nelimination of the program or, if the program serves a\n\nlimited interest, whether it should be redesigned to\n\nrequire users to finance program costs,\n\ne. whether the cost to administer the program exceeds\n\nlicense and other fee revenues paid by those being\n\nregulated, and\n\nf. whether other changes could improve the efficiency and\n\neffectiveness of the program;\n\n6. The consequences of discontinuing such program. If any\n\ndiscontinuation is recommended, such recommendation must be\n\naccompanied by a description of alternatives to implement such\n\nrecommendation, including an implementation schedule for\n\ndiscontinuation and recommended procedures for assisting state\nand\n\nf. whether other changes could improve the efficiency and\n\neffectiveness of the program;\n\n6. The consequences of discontinuing such program. If any\n\ndiscontinuation is recommended, such recommendation must be\n\naccompanied by a description of alternatives to implement such\n\nrecommendation, including an implementation schedule for\n\ndiscontinuation and recommended procedures for assisting state\n\nagency employees affected by the discontinuation;\n\n7. Determination as to public policy, which may include\n\nrecommendations as to whether it would be sound public policy to\n\ncontinue or discontinue funding the program, either in whole or in\n\npart, in the existing manner; and\n\n8. Whether state agency management has established control\n\nsystems sufficient to ensure that performance data are maintained\n\nand supported by state agency records and accurately presented in\n\nstate agency performance reports.\n\nC. Evaluations and reviews may include consideration of\n\nprograms provided by other agencies which are integrally related to\n\nthe programs administered by the state agency.\n\nD. Reports issued upon the completion of any performance\n\nevaluations and program reviews by the Joint Legislative Committee\n\non Budget and Program Oversight shall be submitted to the Governor,\n\nthe Speaker of the House of Representatives and the President Pro\n\nTempore of the State Senate.
