There is hereby created in the State Treasury a revolving\n\nfund to be known and designated as the Tobacco Settlement Fund, into\n\nwhich fund shall be deposited:\n\n1. All monies received by the state or any official, agency or\n\ndepartment of the state in settlement of claims by the state against\n\ntobacco manufacturers during the month of April 2000;\n\n2. All monies received by the state or any official, agency or\n\ndepartment of the state in settlement of claims by the state against\n\ntobacco manufacturers during fiscal year 2001;\n\n3. That portion of monies apportioned to the Tobacco Settlement\n\nFund pursuant to the provisions of subsection B of this section; and\n\n4. Such other monies as may be appropriated or otherwise\n\ndirected thereto by law.\n\nThe Tobacco Settlement Fund shall be a continuing fund, not\n\nsubject to fiscal year limitations. No monies shall be paid out of\n\nsuch fund except pursuant to appropriation by the Legislature.\n\nB. Unless the provisions of subsection C of this section become\n\noperative as law, monies received by the state or any official,\n\nagency or department of the state in settlement of claims by the\n\nstate against tobacco manufacturers not otherwise apportioned\n\npursuant to the provisions of Section 40 of Article X of the\n\nOklahoma Constitution shall be apportioned as follows:\n\n1. Seventy-five percent (75%) shall be apportioned to the\n\nTobacco Settlement Fund; and\n\n2. Twenty-five percent (25%) shall be apportioned to the\n\nAttorney General's Evidence Fund.\n\nC. Monies received by the state or any official, agency or\n\ndepartment of the state in settlement of claims by the state against\n\ntobacco manufacturers not otherwise apportioned pursuant to the\n\nprovisions of Section 40 of Article X of the Oklahoma Constitution,\n\nif the provisions of the State Question as contained in Enrolled\n\nSenate Joint Resolution No. 27 of the 2nd Session of the 57th\n\nOklahoma Legislature are approved by the people, shall be\n\napportioned as follows:\n\n1. Ninety-one and sixty-seven hundredths percent (91.67%) shall\n\nbe apportioned to the Tobacco Settlement Fund; and\n\n2.
