Stat. tit. 62, § 62-582","heading":"Definitions","body":"As used in this act, the following terms have the following\n\nmeanings, unless the context otherwise requires:\n\n1. \"Authorized officer\" means any individual required or\n\npermitted, alone or with others, by any provision of law or by the\n\nissuing public entity, to execute on behalf of the public entity a\n\ncertificated registered public obligation or a writing relating to\n\nan uncertificated registered public obligation;\n\n2. \"Certificated registered public obligation\" means a\n\nregistered public obligation which is represented by an instrument;\n\n3. \"Code\" means the Internal Revenue Code of 1954, as amended;\n\n4. \"Facsimile seal\" means the reproduction by engraving,\n\nimprinting, stamping or other means of the seal of the issuer,\n\nofficial or official body;\n\n5. \"Facsimile signature\" means the reproduction by engraving,\n\nimprinting, stamping or other means of a manual signature;\n\n6. \"Financial intermediary\" means a bank, broker, clearing\n\ncorporation or other person or the nominee of any of them, which in\n\nthe ordinary course of its business maintains registered public\n\nobligation accounts for its customers, when so acting;\n\n7. \"Issuer\" means a public entity which issues an obligation;\n\n8. \"Obligation\" means an agreement of a public entity to pay\n\nprincipal and any interest thereon, whether in the form of a\n\ncontract to repay borrowed money, a lease, an installment purchase\n\nagreement, or otherwise, and includes a share, participation or\n\nother interest in any such agreement;\n\n9. \"Official actions\" means the actions by statute, order,\n\nordinance, resolution, contract or other authorized means by which\n\nthe issuer provides for issuance of a registered public obligation;\n\n10. \"Official or official body\" means the officer or board that\n\nis empowered under the laws of one or more states including this\n\nstate to provide for original issuance of an obligation of the\n\nissuer, by defining the obligation and its terms, conditions and\n\nother incidents, the successor or successors of any such official or\n\nofficial body, and such other person or group of persons as shall be\n\nassigned duties of such official or official body with respect to a\n\nregistered public obligation under applicable law from time to time;\n\n11. \"Public entity\" means an entity, department or agency which\n\nis empowered under the laws of one or more states, territories,\n\npossessions of the United States, or the District of Columbia,\n\nincluding this state, to issue obligations any interest with respect\n\nto which may, under any provision of law, be provided an exemption\n\nfrom the income tax referred to in the Code. The term \"public\n\nentity\" may thus include, without limitation, this state, an entity\n\nderiving powers from and acting pursuant to the State Constitution\n\nor a special legislative act, a political subdivision, a municipal\n\ncorporation, a state university or college, a school or other\n\nspecial district, a joint agreement entity, a public authority, a\n\npublic trust, a nonprofit corporation and other organizations;\n\n12. \"Registered public obligation\" means an obligation issued\n\nby a public entity pursuant to a system of registration;\n\n13. \"System of registration\" and its variants means a plan that\n\nprovides:\n\na. with respect to a certificated registered public\n\nobligation that:\n\n(1) the certificated registered public obligation\n\nspecify a person entitled to the registered\n\npublic obligation and the rights it represents,\n\nand\n\n(2) transfer of the certificated registered public\n\nobligation and the rights it represents may be\n\nregistered upon books maintained for that purpose\n\nby or on behalf of the issuer, and\n\nb. with respect to an uncertificated registered public\n\nobligation that:\nertificated registered public obligation\n\nspecify a person entitled to the registered\n\npublic obligation and the rights it represents,\n\nand\n\n(2) transfer of the certificated registered public\n\nobligation and the rights it represents may be\n\nregistered upon books maintained for that purpose\n\nby or on behalf of the issuer, and\n\nb. with respect to an uncertificated registered public\n\nobligation that:\n\n(1) books maintained by or on behalf of the issuer\n\nfor the purpose of registration of the transfer\n\nof a registered public obligation specify a\n\nperson entitled to the registered public\n\nobligation and the rights evidenced thereby, and\n\n(2) transfer of the uncertificated registered public\n\nobligation and the rights evidenced thereby be\n\nregistered upon such books; and\n\n14. \"Uncertificated registered public obligation\" means a\n\nregistered public obligation which is not represented by an\n\ninstrument.","path":["OK Code","Title 62"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os62.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f24d66aca530bc913c11d77c73a11346f102b9fd5eac26c0a6ea2499549480db","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-62-62-581","next":"us-ok/okla.-stat.-tit.-62-62-583"},"notice":"GroundRules: Original legal text.
