Stat. tit. 62, § 62-690.2","heading":"Definitions","body":"For the purposes of Section 690.1 et seq. of this title:\n\n1. \"Authority\" means an \"Enterprise District Management\n\nAuthority\" created pursuant to Section 690.7 of this title;\n\n2. \"Building\" means a structure consisting of a foundation,\n\nwalls, roof and other parts necessary to its occupation; provided\n\nhowever, it shall not include a structure intended to be used for\n\nresidence purposes;\n\n3. \"Enterprise\" means any form of business organization\n\nincluding, but not limited to, any partnership, sole proprietorship,\n\ncorporation, limited liability company or other legally constituted\n\nbusiness entity;\n\n4. \"Enterprise district\" means at least three but not more than\n\nsix contiguous enterprise zones formed for the purpose of issuing\n\ngeneral obligation bonds;\n\n5. \"Enterprise zone\" means:\n\na. a county which:\n\n(1) has experienced a decrease in population during\n\nthe ten-year period preceding the date as of\n\nwhich an establishment either enters into a\n\ncommitment to locate or announces a plan to\n\nlocate within an enterprise zone or expands\n\nactivity within an existing enterprise zone as\n\ndetermined by the Oklahoma Department of\n\nCommerce, or\n\n(2) has been determined to rank in the lowest one-\n\nthird (1/3) of all counties, which for purposes\n\nof this division shall be computed as the lowest\n\ntwenty-five (25) counties, for per capita\n\npersonal income as measured by the Bureau of\n\nEconomic Analysis for the Oklahoma region for the\n\ncalendar year preceding the beginning of the\n\nfiscal year for which an application is made\n\npursuant to Section 690.3 of this title,\n\nb. an area within or contiguous to the corporate limits\n\nof any city or town of this state which the Oklahoma\n\nDepartment of Commerce determines, upon application,\n\nas an area of economic distress. For purposes of this\n\nsubparagraph, an area within or contiguous to the\n\ncorporate limits of a city or town may be determined\n\nto be an area of economic distress if it consists of\n\none or more census tracts located within a city or\n\ntown or contiguous to a city or town. The area as\n\ndefined by this subparagraph must:\n\n(1) contain a population of persons equal to or\n\ngreater than thirty percent (30%) of the total\n\npopulation the household income for whom is equal\n\nto or less than the poverty level as measured by\n\nthe U.S. Census Bureau for the Oklahoma region\n\nfor the most recent year for which data is\n\navailable prior to the date an application is\n\nmade pursuant to Section 690.3 of this title, or\n\n(2) contain a population of persons the per capita\n\ngross income for whom is fifteen percent (15%) or\n\nmore below the state per capita income,\n\nc. an area designated as a federal enterprise community\n\nas provided by Section 690.3 of this title, or\n\nd. any enterprise zone designated by the Oklahoma\n\nDepartment of Commerce prior to July 1, 2000;\n\n6. \"Equipment\" means machinery necessary to the construction or\n\nmanufacture of products for resale;\n\n7. \"Expand\" means to make expenditures to add land, buildings,\n\nmachinery, equipment or other materials, except inventory, to a\n\nfacility that equal at least ten percent (10%) of the market value\n\nof the facility prior to such expenditures, as determined for the\n\npurposes of local property taxation;\n\n8. \"Facility\" means an enterprise's place of business in an\n\nenterprise zone, including land, buildings, machinery, equipment and\n\nother materials, except inventory used in business. Except as\n\nprovided by subsection B of Section 11 of this act, “facility” does\n\nnot include an establishment used primarily for making retail sales;\n\n9. \"Full-time employee\" means an individual who is employed for\n\nconsideration by an enterprise for at least thirty-five (35) hours a\n\nweek, or who renders any other standard of service generally\n\naccepted by custom or specified by contract as full-time employment;\nty” does\n\nnot include an establishment used primarily for making retail sales;\n\n9. \"Full-time employee\" means an individual who is employed for\n\nconsideration by an enterprise for at least thirty-five (35) hours a\n\nweek, or who renders any other standard of service generally\n\naccepted by custom or specified by contract as full-time employment;\n\n10. \"New employee\" means a full-time employee first employed by\n\nan enterprise at a facility after the designation of an enterprise\n\nzone;\n\n11. \"Position\" means the position of one full-time employee\n\nperforming a particular set of tasks and duties;\n\n12. \"Priority Enterprise Zones\" means enterprise zones which\n\nare selected to receive additional resources or programs after\n\nmeeting the criteria specified in this act;\n\n13. \"Project\" means any undertaking by an enterprise to\n\nestablish a facility or to improve a facility by expansion, in an\n\nenterprise zone or enterprise district;\n\n14. \"Responsible tenant\" means any person, partnership, firm,\n\ncompany or corporation whether organized for profit or not deemed by\n\nthe Authority, after proper investigation, to be financially\n\nresponsible to assume all rental and all other obligations\n\nprescribed by the Authority in the leasing of any building or\n\nequipment on which the Authority has a loan outstanding; and\n\n15. \"Renovate\" means to make expenditures to alter or repair a\n\nfacility that equal at least fifty percent (50%) of the market value\n\nof the facility prior to such expenditures, as determined for the\n\npurposes of local property taxation.","path":["OK Code","Title 62"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os62.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b3da850c31f246c8a3329ddaa44daeb76a3abd8b6ea0a8122fcc7e7974b8f4c5","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-62-62-690.19","next":"us-ok/okla.-stat.-tit.-62-62-690.20"},"notice":"GroundRules: Original legal text.
