As used in this section, \"public finance service provider\"\n\nmeans underwriters, bond or other legal counsel, financial advisors,\n\nconsultants, and financial institutions who serve as trustee, paying\n\nagent or in any fiduciary capacity, who seek to provide services to\n\nState Governmental Entities or Local Governmental Entities with\n\nregard to the issuance of bonds, notes or other evidences of\n\nindebtedness.\n\nB. Any public finance service provider shall be required to\n\nmake a disclosure, upon such form as the Deputy Treasurer for Debt\n\nManagement may prescribe, of any and all direct financial\n\ncontributions made by the public finance service provider which\n\nexceed Five Thousand Dollars ($5,000.00) in any calendar year on a\n\ncumulative basis to any nonprofit organization, regardless of its\n\nexempt status pursuant to the provisions of the Internal Revenue\n\nCode of 1986, as amended, the primary purpose of which is to provide\n\nservices to one or more political subdivisions of the state or the\n\nmembership of which consists primarily of public school\n\nadministrators, common school districts or common school district\n\nboards of education, common school superintendents, career\n\ntechnology districts or career technology district governing boards,\n\nmunicipal government entities, county commissioners or other public\n\nofficials or local government entity having authority to issue debt\n\nobligations either directly or which is the beneficiary of a public\n\ntrust organized pursuant to the provisions of Section 176 et seq. of\n\nTitle 60 of the Oklahoma Statutes.\n\nC. In addition, the public finance service provider shall be\n\nrequired to make disclosure of any and all direct financial\n\ncontributions which exceed One Hundred Dollars ($100.00) on a\n\ncumulative basis during any calendar year made to any elected\n\nofficials or employees of a State Governmental Entity or Local\n\nGovernmental Entity to which financial services are to be provided\n\nin connection with issuance of debt obligations or contributions\n\nmade to any individuals associated with any of the nonprofit\n\norganizations described by subsection B of this section.\n\nD. The disclosure shall be filed annually with the Deputy\n\nTreasurer for Debt Management not later than January 15, or the\n\nfirst business day after such date if January 15 is not a date upon\n\nwhich the State Treasurer's office is open for business, and shall\n\ninclude an itemized description of all direct financial\n\ncontributions made to any and all of the entities described by\n\nsubsections B and C of this section by the public finance service\n\nprovider during the immediately preceding calendar year.\n\nE. Any public finance service provider shall submit a copy of\n\nthe most recent disclosure document on file with the Deputy\n\nTreasurer for Debt Management as required pursuant to subsection D\n\nof this section prior to the selection of a public finance service\n\nprovider by any county, city, town, common school district, career\n\ntechnology district or other local government entity or any public\n\ntrust organized pursuant to the provisions of Section 176 et seq. of\n\nTitle 60 of the Oklahoma Statutes having one or more political\n\nsubdivisions as its beneficiary or beneficiaries, with respect to\n\nthe issuance of any obligations described by subsection A of this\n\nsection. The disclosure document shall be provided to each member\n\nof the governing board of the unit of local government to which\n\nservices will be provided and, if applicable, to each member of the\n\nboard of trustees of any public trust as described in this\n\nsubsection to which public finance services will be provided. If\n\nthe board of trustees of such public trust is comprised of persons\n\nwho are also members of the governing board of the unit of local\n\ngovernment, the disclosure document may be provided to the members\nich\n\nservices will be provided and, if applicable, to each member of the\n\nboard of trustees of any public trust as described in this\n\nsubsection to which public finance services will be provided.
