Stat. tit. 62, § 62-7003","heading":"Incentive Evaluation Commission - Incentive Approval","body":"Committee.\n\nA. There is hereby established the Incentive Evaluation\n\nCommission consisting of:\n\n1. A certified public accountant appointed by the Oklahoma\n\nAccountancy Board whose term shall expire on December 31, 2025;\n\n2. The Chair of Select Oklahoma an Economic Development\n\nPartnership, Inc. or his or her designee who is also a member of\n\nSelect Oklahoma an Economic Development Partnership, Inc. who shall\n\nserve during his or her term of office as Chair of Select Oklahoma\n\nan Economic Development Partnership, Inc.;\n\n3. An auditor who is employed as an internal auditor by a\n\ncompany or who is employed by a private auditing firm appointed by\n\nthe Governor whose term shall expire on December 31, 2025;\n\n4. An economist from an Oklahoma college or university\n\nappointed by the President Pro Tempore of the Senate whose term\n\nshall expire on December 31, 2024;\n\n5. A lay person who is not an elected official appointed by the\n\nSpeaker of the House of Representatives whose term shall expire\n\nDecember 31, 2024;\n\n6. The Chair of the Oklahoma Tax Commission or his or her\n\ndesignee who is also a member of the Oklahoma Tax Commission, which\n\nshall be an ex officio and nonvoting position;\n\n7. The Director of the Office of Management and Enterprise\n\nServices or his or her designee who is an employee of the Office of\n\nManagement and Enterprise Services which shall be an ex officio and\n\nnonvoting position; and\n\n8. The Secretary of Commerce or his or her designee who is an\n\nemployee of the Oklahoma Department of Commerce which shall be an ex\n\nofficio and nonvoting position.\n\nB. Thereafter persons shall be appointed for terms of four (4)\n\nyears beginning on January 1. Any vacancy shall be filled by the\n\nappointing authority for the remainder of the unexpired term.\n\nC. No person shall serve on the Commission or be appointed to\n\nthe Commission who is employed by a company that receives any\n\nincentive or who holds a substantial interest in ownership in a\n\ncompany that receives any incentive. As used in this subsection,\n\n“substantial interest” shall mean the ownership, directly or\n\nindirectly, of more than fifty percent (50%) of the equity interest\n\nwith voting rights for any lawfully recognized business entity.\n\nD. No person shall be appointed to the Commission who at the\n\ntime of his or her appointment is an elected official. Any person\n\nwho is appointed to the Commission who subsequently becomes an\n\nelected official during his or her term on the Commission shall be\n\nrequired to vacate his or her position on the Commission.\n\nE. The Office of Management and Enterprise Services shall\n\nprovide staff and administrative support to the Incentive Evaluation\n\nCommission. The Oklahoma Department of Commerce and the Oklahoma\n\nTax Commission shall assist the Office of Management and Enterprise\n\nServices as needed in providing staff and administrative support to\n\nthe Commission.\n\nF. The Incentive Approval Committee is hereby created as a\n\nsubcommittee of the Incentive Evaluation Commission and shall\n\nconsist of the Director of the Office of Management and Enterprise\n\nServices or his or her designee, the Secretary of Commerce or his or\n\nher designee, and the Chairman of the Tax Commission or his or her\n\ndesignee. It shall be the duty of the Committee to determine:\n\n1. Upon initial application on a form approved by the\n\nCommittee, if an establishment is engaged in a basic industry as\n\ndefined in subdivision (b) of division (7) or in subdivisions (a)\n\nthrough (n) of division (9) of subparagraph a of paragraph 1 of\n\nsubsection A of Section 3603 of Title 68 of the Oklahoma Statutes or\n\nas otherwise provided by subsection C of Section 3603 of Title 68 of\n\nthe Oklahoma Statutes;\n\n2. If an establishment would have been defined as a “basic\n\nindustry” prior to the amendments to Section 3603 of Title 68 of the\n\nOklahoma Statutes to convert from SIC Codes to NAICS Codes. If the\n9) of subparagraph a of paragraph 1 of\n\nsubsection A of Section 3603 of Title 68 of the Oklahoma Statutes or\n\nas otherwise provided by subsection C of Section 3603 of Title 68 of\n\nthe Oklahoma Statutes;\n\n2. If an establishment would have been defined as a “basic\n\nindustry” prior to the amendments to Section 3603 of Title 68 of the\n\nOklahoma Statutes to convert from SIC Codes to NAICS Codes. If the\n\nCommittee so determines, the establishment shall be considered as a\n\n“basic industry” for purposes of the Oklahoma Quality Jobs Program\n\nAct; and\n\n3. If employees of an establishment as defined in division (10)\n\nof subparagraph a of paragraph 1 of subsection A of Section 3603 of\n\nTitle 68 of the Oklahoma Statutes meet the requirements to be\n\nconsidered employed in new direct jobs as specified in paragraph 3\n\nof subsection A of Section 3603 of Title 68 of the Oklahoma\n\nStatutes.\n\nG. For an establishment defined as a “basic industry” pursuant\n\nto division (4) of subparagraph a of paragraph 1 of subsection A of\n\nSection 3603 of Title 68 of the Oklahoma Statutes, the Incentive\n\nApproval Committee shall consist of the members provided by\n\nsubsection A of this section and the Executive Director of the\n\nOklahoma Center for the Advancement of Science and Technology, or a\n\ndesignee from the Center appointed by the Executive Director.","path":["OK Code","Title 62"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os62.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e83936b869fa5bbc9de966d244db3f005325a9cd0c9899069b26306a2bd4f602","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-62-62-7002","next":"us-ok/okla.-stat.-tit.-62-62-7004"},"notice":"GroundRules: Original legal text.
