Stat. tit. 62, § 62-7005","heading":"Contractors – Evaluation process – Requirements –","body":"Criteria – Records disclosure.\n\nA. The Commission may contract with a private company,\n\nnonprofit, or academic institution to assist with evaluation of each\n\nincentive. The Commission shall develop a scope of services for a\n\nrequest for proposals issued pursuant to the Oklahoma Central\n\nPurchasing Act, Section 85.1 et seq. of Title 74 of the Oklahoma\n\nStatutes, for professional services necessary to complete incentive\n\nevaluations pursuant to the Incentive Evaluation Act. The scope of\n\nservices shall include a provision requiring the contractor to\n\nprovide at least one draft report for each incentive prior to the\n\nissuance of the final report; provided, the contractor may determine\n\nthe timing and frequency of draft reports based on the availability\n\nof information and the potential for draft reports to assist the\n\nCommission in making a final recommendation. The cost of such\n\ncontract shall be paid by the Office of Management and Enterprise\n\nServices. No recipient or potential recipient of an incentive or\n\nrepresentative of a recipient or potential recipient shall contact\n\nthe entity or individual with whom the Commission contracts pursuant\n\nto this subsection unless the entity or individual specifically\n\nrequests information or documentation for purposes of the incentive\n\nevaluation process; provided, this shall not be construed to prevent\n\nparticipation in a public hearing conducted pursuant to subsection B\n\nof this section.\n\nB. By October 1 of each year beginning in calendar year 2023,\n\nthe Commission or the Commission’s chosen contractor shall evaluate\n\neach incentive scheduled for review that year. The Commission or\n\nthe Commission’s chosen contractor shall conduct each incentive\n\nevaluation in consultation with the Oklahoma Department of Commerce\n\ndivision of Research and Economic Analysis Services using criteria\n\ndeveloped pursuant to subsection D of this section. Between October\n\n1 and November 30 of each year beginning in 2017, the Commission\n\nshall hold at least one public meeting to review, allow for public\n\ncomment, and vote to approve, disapprove, or modify each incentive\n\nevaluation conducted that year. By December 15 of each year\n\nbeginning in 2016, the Commission shall provide the results of each\n\nincentive evaluation, a review of prior Commission recommendations,\n\nand changes to statute or incentive administration related to\n\nincentive evaluation recommendations in a written report to the\n\nGovernor, President Pro Tempore of the Senate, and Speaker of the\n\nHouse of Representatives. If the Commission votes to modify an\n\nincentive evaluation as provided in this subsection, such\n\nmodification and the original evaluation shall be documented in the\n\nannual written report. The report shall be made publicly available\n\non the Oklahoma Department of Commerce website, the Commission\n\nwebsite, and documents.ok.gov.\n\nC. Each evaluation shall include the following:\n\n1. An estimate of the economic and fiscal impact of the\n\nincentive. This estimate shall take into account the following\n\nconsiderations in addition to other relevant factors:\n\na. the extent to which the incentive changes business\n\nbehavior,\n\nb. the results of the incentive for the economy of\n\nOklahoma as a whole. This consideration includes both\n\npositive direct and indirect impacts and any negative\n\neffects on other Oklahoma businesses, and\n\nc. a comparison to the results of other incentives or\n\nother economic development strategies with similar\n\ngoals;\n\n2. An assessment of whether adequate protections are in place\n\nto ensure the fiscal impact of the incentive does not increase\n\nsubstantially beyond the state’s expectations in future years;\n\n3. An assessment of whether the incentive is being administered\n\neffectively;\n\n4. An assessment of whether the incentive is achieving its\n\ngoals;\n\n5. Recommendations for how the state can most effectively\nls;\n\n2. An assessment of whether adequate protections are in place\n\nto ensure the fiscal impact of the incentive does not increase\n\nsubstantially beyond the state’s expectations in future years;\n\n3. An assessment of whether the incentive is being administered\n\neffectively;\n\n4. An assessment of whether the incentive is achieving its\n\ngoals;\n\n5. Recommendations for how the state can most effectively\n\nachieve the incentive’s goals, including recommendations on whether\n\nthe incentive should be retained, reconfigured, or repealed; and\n\n6. Recommendations for any changes to state policy, rules, or\n\nstatutes that would allow the incentive to be more easily or\n\nconclusively evaluated in the future. These recommendations may\n\ninclude changes to collection, reporting, and sharing of data, and\n\nrevisions or clarifications to the goal of the incentive.\n\nD. Evaluation criteria shall be developed for each incentive\n\nevaluated by the Commission. Each incentive shall be evaluated\n\nusing criteria specific to the individual incentive. The criteria\n\nshall be developed by the Commission through the administrative\n\nrulemaking process pursuant to the Administrative Procedures Act,\n\nSection 250 et seq. of Title 75 of the Oklahoma Statutes, and\n\ncodified in the administrative code of the Oklahoma Department of\n\nCommerce.\n\nE. At the request of the Incentive Evaluation Commission,\n\nunless prohibited by the Oklahoma Constitution, Oklahoma Statutes,\n\nor federal law, state agencies shall provide any records,\n\ninformation, data, or data analysis necessary for the Commission or\n\ncontractors to effectively evaluate incentives.
