Stat. tit. 62, § 62-825","heading":"Preliminary Project Plan – Public hearing – Notice – Final","body":"Project Plan.\n\nA. Upon a request by the Governor, the Oklahoma Department of\n\nCommerce shall prepare a Preliminary Project Plan relating to a\n\nproposed project. This Preliminary Project Plan shall set forth the\n\nfollowing information:\n\n1. A description of the economic development project, including\n\nthe name of private companies being assisted, if any, and the nature\n\nof such assistance;\n\n2. An estimate of the total project costs of the project;\n\n3. A description of the bonds proposed to be issued, including\n\nthe par amount of bonds proposed for issuance by each municipality\n\nor county comprising the proposed Regional District;\n\n4. A listing of the municipalities and counties comprising the\n\nproposed Regional District;\n\n5. A description of the economic impact that the project will\n\nhave on the municipalities and counties comprising the proposed\n\nRegional District;\n\n6. A description of the type and amount of tax that will be\n\nauthorized for the payment of principal, interest and premium, if\n\nany, on the bonds;\n\n7. The name of the public trust designated to administer the\n\nproject; and\n\n8. Such other information as the Department may deem\n\nappropriate.\n\nB. Following the preparation of the Preliminary Project Plan,\n\nthe Department shall conduct public hearings for the purpose of\n\nreceiving input from the public regarding the Preliminary Project\n\nPlan. If the proposed Regional District consists of one county, the\n\npublic hearing shall be held in the incorporated municipality having\n\nthe highest population in the county according to the most recent\n\nFederal Decennial Census or most recent annual estimate of such\n\npopulation. If the proposed Regional District consists of more than\n\none county, the public hearing shall be held in the municipality\n\nhaving the highest population in each such county according to the\n\nmost recent Federal Decennial Census or most recent annual estimate\n\nof such population. If the proposed Regional District consists of\n\none municipality, the public hearing shall be held in such\n\nmunicipality. If the proposed Regional District consists of more\n\nthan one municipality, the public hearing shall be held in each such\n\nmunicipality. If the proposed Regional District consists of one\n\nmunicipality and one county, the public hearing shall be held in the\n\nmunicipality and, if not a duplication of the hearing location, in\n\nthe municipality within the county having the highest population\n\naccording to the most recent Federal Decennial Census or most recent\n\nannual estimate of such population. If the proposed Regional\n\nDistrict consists of more than one municipality and more than one\n\ncounty and the public hearing location is not otherwise prescribed\n\nby this subsection, the public hearing shall be held in each of the\n\nmunicipalities and, if not already satisfied by the hearing\n\nrequirement prescribed by this paragraph, for purposes of a hearing\n\nin any of the affected counties, the public hearing shall be held in\n\neach of the municipalities having the highest population in each\n\ncounty according to the most recent Federal Decennial Census or most\n\nrecent annual estimate of such population.\n\nC. Notice of the time, date, and place of the public hearings\n\nshall be published in one or more newspapers of general circulation\n\nwithin each of the municipalities and counties comprising the\n\nproposed Regional District. The notice shall also inform the public\n\nthat a copy of the Preliminary Project Plan can be obtained from the\n\nDepartment without charge. Such publication shall be at least seven\n. Notice of the time, date, and place of the public hearings\n\nshall be published in one or more newspapers of general circulation\n\nwithin each of the municipalities and counties comprising the\n\nproposed Regional District. The notice shall also inform the public\n\nthat a copy of the Preliminary Project Plan can be obtained from the\n\nDepartment without charge. Such publication shall be at least seven\n\n(7) days prior to the hearings. At the hearings, comments from all\n\ninterested persons shall be received by the Department and a record\n\nmade of such comments.\n\nD. After the public hearings are concluded, the Department\n\nshall prepare a Final Project Plan, based upon the Preliminary\n\nProject Plan, but giving due consideration to the comments received\n\nat the public hearings. The Final Project Plan shall also include a\n\ncertification by the Department that the proposed project will have\n\na substantial economic impact on each of the municipalities and\n\ncounties proposed for inclusion in the Regional District. The Final\n\nProject Plan shall include the same items listed in subsection A of\n\nthis section. No municipalities or counties may be listed in the\n\nFinal Project Plan for inclusion in a Regional District other than\n\nthose listed in the Preliminary Project Plan. A municipality or\n\ncounty may be omitted in the Final Project Plan if the Department\n\ndetermines that the project will not have a substantial economic\n\nimpact within such municipality or county.
