Stat. tit. 62, § 62-841","heading":"Definitions","body":"As used in the Oklahoma Local Development and Enterprise Zone\n\nIncentive Leverage Act:\n\n1. “Enterprise” means any form of business organization\n\nincluding, but not limited to, any partnership, sole proprietorship,\n\ncorporation, limited liability company or other legally constituted\n\nbusiness entity;\n\n2. “Enterprise zone” means an area as defined pursuant to\n\nparagraph 5 of Section 690.2 of this title;\n\n3. “Estimated direct state benefits” means the total\n\nincremental state tax revenues new to the state estimated by the\n\nOklahoma Department of Commerce to accrue to the state from new\n\ninvestments and new employment during the period of apportionment of\n\nlocal sales taxes as a result of the project and/or projects\n\ndescribed in the related project plan. For purposes of projecting\n\nstate benefits for a military growth impact project, the military\n\ngrowth impacts shall be used in lieu of the project and/or projects\n\ndescribed in the related project plan. In projecting such benefits,\n\nthe Oklahoma Department of Commerce shall consider, if practicable,\n\nwhether or not the project plan involves an enterprise:\n\na. relocating from within the state,\n\nb. subject to or in the process of recruitment by two or\n\nmore governmental entities within the state, or\n\nc. which will be in direct competition with an existing\n\nenterprise located in the state;\n\n4. “Estimated direct state costs” means the costs projected by\n\nthe Oklahoma Department of Commerce to be incurred by the state\n\nduring the period of apportionment of local sales taxes, as a result\n\nof the project and/or projects described in the related project\n\nplan. For purposes of projecting state costs for a military growth\n\nimpact project, the military growth impacts shall be used in lieu of\n\nthe project and/or projects described in the related project plan;\n\n5. “Estimated net direct state benefits” means the estimated\n\ndirect state benefits less the estimated direct state costs;\n\n6. “Facility” means the definition contained in paragraph 8 of\n\nSection 690.2 of this title;\n\n7. “Governing body” means the governing board of a local\n\ngovernmental entity in the case of a single incentive district or\n\nincrement district when the boundaries of the district are\n\ncoextensive with or contained within the jurisdiction of any such\n\nsingle local governmental entity or the governing boards of a\n\ncombination of counties, cities, or towns forming an incentive\n\ndistrict or an increment district pursuant to the provisions of the\n\nLocal Development Act;\n\n8. “Incentive district” means an area created pursuant to the\n\nprovisions of the Local Development Act, including Section 856 of\n\nthis title;\n\n9. “Increment district” means an area created pursuant to the\n\nprovisions of the Local Development Act;\n\n10. “Local governmental entity” means a county, city or town\n\nforming an incentive district or an increment district pursuant to\n\nthe provisions of the Local Development Act;\n\n11. “Local sales taxes” means amounts payable to or for the\n\nbenefit of a local governmental entity calculated as a percentage,\n\nwhich, except on transient lodgings, shall not exceed four and one-\n\nhalf percent (4.5%) of gross sales whether imposed by ordinance,\n\nresolution, covenant, or agreement;\n\n12. “Major tourism destination project” means a project which:\n\na. meets the definition of a “tourism attraction” as set\n\nforth in subparagraph a of paragraph 10 of Section\n\n2357.36 of Title 68 of the Oklahoma Statutes, subject\n\nonly to the restrictions of divisions (1), (3) and (6)\n\nof subparagraph b of paragraph 10 of Section 2357.36\n\nof Title 68 of the Oklahoma Statutes,\n\nb. is projected to meet the following qualifications\n\nwithin three (3) years of the date of substantial\n\ncompletion of the project based upon the findings of\n\nthe Oklahoma Department of Commerce:\n\n(1) at least Fifty Million Dollars ($50,000,000.00)\n\nin capital investment,\nons of divisions (1), (3) and (6)\n\nof subparagraph b of paragraph 10 of Section 2357.36\n\nof Title 68 of the Oklahoma Statutes,\n\nb. is projected to meet the following qualifications\n\nwithin three (3) years of the date of substantial\n\ncompletion of the project based upon the findings of\n\nthe Oklahoma Department of Commerce:\n\n(1) at least Fifty Million Dollars ($50,000,000.00)\n\nin capital investment,\n\n(2) at least Fifty Million Dollars ($50,000,000.00)\n\nin projected annual gross sales revenues or at\n\nleast Ten Million Dollars ($10,000,000.00) in\n\nannual gross sales revenues to out-of-state\n\nvisitors,\n\n(3) a number of out-of-state visitors of at least:\n\n(a) twenty percent (20%) of the number of total\n\nvisitors, or\n\n(b) twenty thousand (20,000) visitors per year,\n\nand\n\n(4) a number of visitors traveling at least one\n\nhundred (100) miles of at least:\n\n(a) thirty percent (30%) of the number of total\n\nvisitors, or\n\n(b) twenty-five thousand (25,000) visitors per\n\nyear, or\n\nc. is a lake resort project, containing a hotel, a\n\nconference center, and an eighteen-hole golf course,\n\nlocated within twenty-five (25) linear miles of the\n\nstate boundary on a lake containing at least forty-\n\nfive thousand (45,000) surface acres of water, that is\n\nestimated to generate at least Fifty Million Dollars\n\n($50,000,000.00) in capital investment;\n\n13. “Military growth impacts” means the increases in\n\ninvestment, employment, and residents resulting from military growth\n\nactivities;\n\n14. “Military growth impact community” means a city, town, or\n\ncounty experiencing and reasonably projected to experience a\n\npopulation growth of at least one thousand (1,000) persons and\n\nincreased payrolls of at least Ten Million Dollars ($10,000,000.00)\n\nwithin a five-year period directly resulting from federal military\n\nbase activities;\n\n15. “Military growth impact project” means a project pursuant\n\nto the Local Development Act which the governing body determines to\n\nbe in support of the needs and quality of life issues resulting from\n\nthe military growth impacts;\n\n16. “Net benefit rate” means the estimated net direct state\n\nbenefits computed as a percentage of gross taxable sales derived\n\nfrom the project during the period of apportionment of local sales\n\ntaxes by the local governmental entity;\n\n17. “Public entity” means those entities described in the Local\n\nDevelopment Act;\n\n18. “Retail purposes” means the objectives of selling tangible\n\npersonal property, other than art, on the physical premises of an\n\nestablishment. Retail purposes shall not mean a hotel, motel,\n\nentertainment facility, museum, cultural facility, art gallery,\n\nrestaurant supporting another establishment excluded herein,\n\nmilitary growth impact project located within a military growth\n\nimpact community, or a major tourism destination project;\n\n19. “State local enterprise matching payment” means the payment\n\nauthorized by subsection A of Section 844 of this title; and\n\n20. “State local government matching payment” means the payment\n\nauthorized by subsection D of Section 844 of this title.","path":["OK Code","Title 62"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os62.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a17ac399833f161d77a248d2c5097362090edcd74f376dce4a8734f98222cd20","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-62-62-840","next":"us-ok/okla.-stat.-tit.-62-62-842"},"notice":"GroundRules: Original legal text.
