Stat. tit. 62, § 62-858","heading":"Project plans - Amendments - Vote on project plan adopted","body":"by transportation authority.\n\nA. The governing body shall cause to be prepared a project\n\nplan. The appropriate local planning commission shall review the\n\nproposed project plan and shall make a recommendation on the plan to\n\nthe governing body. The project plan shall include the following\n\nitems, if applicable, according to the type of district being\n\nformed:\n\n1. A description of the proposed boundaries of the district and\n\nthe proposed boundaries of the project area by legal description and\n\nby street or other recognizable physical feature accompanied by a\n\nsketch clearly delineating the area in detail;\n\n2. A general description of the proposed public works or\n\nimprovements, the anticipated private investments and the estimated\n\npublic revenues which should accrue;\n\n3. A list of estimated project costs including administrative\n\nexpenses;\n\n4. A general description of the methods of financing the\n\nestimated project costs, the expected sources of revenue to finance\n\nor pay project costs, and the general time when the costs or\n\nmonetary obligations related thereto are to be incurred;\n\n5. A map showing existing uses and conditions of real property\n\nin the district and a map showing proposed improvements to and\n\nproposed uses of that property;\n\n6. Proposed changes in zoning;\n\n7. Proposed changes in the master plan and city ordinances if\n\nrequired to implement the project plan;\n\n8. The name of the person who shall be in charge of the\n\nimplementation of all of the project plans of the district with such\n\nname being forwarded to the Department of Commerce; and\n\n9. A designation of any public entity to be authorized to carry\n\nout all or any part of the project plan.\n\nB. Before the governing body may approve such project plan,\n\nnotice must be given and public hearings must be held pursuant to\n\nthe provisions of Section 859 of this title. The approval by the\n\ngoverning body must be by ordinance if a city or town or by\n\nresolution if a county which contains findings that the plan is\n\nfeasible and conforms to the master plan, if any, of the city, town\n\nor county.\n\nC. Except as otherwise provided in this section, the planning\n\ncommission may recommend an amendment to a project plan, which\n\namendment shall be subject to review by the review committee and\n\napproval by the governing body. Prior to the adoption of the\n\namendment, the governing body shall give notice concerning such\n\namendment and hold public hearings on such amendment in the manner\n\nprescribed by Section 859 of this title. The approval by the\n\ngoverning body must be by ordinance if a city or town or by\n\nresolution of a county which contains findings that the plan is\n\nfeasible and conforms to the master plan, if any, of the city, town\n\nor county.\n\nD. The governing body may grant the department, agency or\n\npublic entity in charge of the implementation of the project plan\n\nthe authority to make minor amendments to the plan. An amendment is\n\nconsidered to be minor if such amendment does not change the\n\ncharacter or purpose of the plan; does not add more than five\n\npercent (5%) to the district's area; or does not add more than five\n\npercent (5%) to the public costs of the plan to be financed by\n\napportioned tax increments. All amendments made pursuant to the\n\nprovisions of this subsection shall be considered on a cumulative\n\nbasis.\n\nE. Approval by any ad valorem taxing entities, if required\n\npursuant to the provisions of Section 850 et seq. of this title,\n\nshall be secured before any plan or amendment thereto goes into\n\neffect.\n\nF. Any project plan adopted by a transportation authority\n\npursuant to Section 1370.7 of Title 68 of the Oklahoma Statutes,\n\nafter having met the provisions of this section, shall be submitted\n\nto a vote of the people within the boundaries of the authority,\n\npursuant to the provisions of subsections D through H of Section 868\n\nof this title.","path":["OK Code","Title 62"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os62.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2cd4e6596e129898b48b8f846a731d008cdf079e95ad707b381f407f0fa468d5","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-62-62-857","next":"us-ok/okla.-stat.-tit.-62-62-859"},"notice":"GroundRules: Original legal text.
