Stat. tit. 62, § 62-885","heading":"Procedures for establishing housing reinvestment district","body":"- Adoption of ordinance or resolution - Initiative and referendum.\n\nA. The governing body of a municipality or county may establish\n\na housing reinvestment district as follows:\n\n1. A housing reinvestment district may only be created in a\n\nmunicipality or county with a population of less than three hundred\n\nthousand (300,000) persons and in which the percentage change in\n\npopulation, according to the most recent federal decennial census or\n\nthe most recent population estimate provided by the United States\n\nBureau of the Census, compared with the previous federal decennial\n\ncensus, is less than the national average percentage change in\n\npopulation; provided, a municipality or county which does not meet\n\nsuch requirement may create a housing reinvestment district in a\n\nspecific geographic area thereof which meets the definition of an\n\n“opportunity zone” as such term is defined in paragraph 2 of\n\nsubsection G of Section 3604 of Title 68 of the Oklahoma Statutes;\n\n2. The governing body shall designate and adopt the proposed\n\nboundaries of any such district. Except as otherwise provided in\n\nthis subsection, the boundaries of any district created by a\n\nmunicipality shall be confined to that territory within the\n\ncorporate limits of the municipality and any district created by a\n\ncounty shall be confined to that territory within the unincorporated\n\nareas of the county. Any municipality or county may by written\n\nagreement jointly create a contiguous district with one or more\n\nother municipalities or counties;\n\n3. The governing body shall obtain the written consent of each\n\ntaxing entity levying ad valorem taxes upon property located in the\n\nproposed boundaries of the district to grant tax abatements as\n\nprovided in Section 6 of this act. If such written consent is not\n\nobtained from each taxing entity, the district shall not be created.\n\nThe governing body shall further enter into a contractual\n\narrangement with the governing bodies of all other affected taxing\n\nentities to provide relief from ad valorem taxes as provided in\n\nSection 6 of this act;\n\n4. Upon the adoption and approval of the proposed boundaries of\n\nthe district, the governing body shall, after public notice and\n\nhearing, adopt an ordinance or resolution, whichever is applicable,\n\nwhich:\n\na. describes the boundaries of the district sufficiently\n\ndefinite to identify with ordinary and reasonable\n\ncertainty the territory included in it,\n\nb. creates the district as of a specified date,\n\nc. assigns a name to the district for identification\n\npurposes, and\n\nd. contains findings that:\n\n(1) the municipality or county or portion thereof in\n\nwhich the proposed district is located meets the\n\nrequirements of paragraph 1 of this subsection,\n\nand\n\n(2) the improvement to housing in the area of the\n\ndistrict caused by the granting of tax abatements\n\npursuant to the provisions of this act is likely\n\nto enhance the value of other real property in\n\nthe municipality or county and to promote the\n\ngeneral public interest.\n\nB. The powers of initiative and referendum, reserved by the\n\nOklahoma Constitution to the people, are reserved to the people of\n\nevery municipality or county with reference to the tax relief or\n\nincentives or exemptions or increment captured as authorized by\n\nSection 6C of Article X of the Oklahoma Constitution and as provided\n\nfor in this act. A housing reinvestment district may be created\n\nthrough an initiative or referendum petition pursuant to the\n\nprocedures set forth in Section 868 of Title 62 of the Oklahoma\n\nStatutes. A housing reinvestment district may also be terminated,\n\nwhether created pursuant to the provisions of subsection A of this\n\nsection or through an initiative or referendum petition, through an\n\ninitiative or referendum petition pursuant to such procedures.","path":["OK Code","Title 62"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os62.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"6609f425e06bfb5cd25d995fe6f9181bbe59ff704269f7ceb763ceaa867ddfe9","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-62-62-884","next":"us-ok/okla.-stat.-tit.-62-62-886"},"notice":"GroundRules: Original legal text.
