The Long-Range Capital Planning Commission shall submit an\n\nitemized list of the proposed projects set forth in its annual\n\ncapital plan to the Governor, the President Pro Tempore of the\n\nSenate and the Speaker of the House of Representatives within the\n\nfirst seven (7) legislative days of a regular legislative session.\n\nThe list shall be in the order of the priority of the projects as\n\ndetermined by the Commission. The submission to such elected\n\nofficials shall occur upon the same date for purposes of computing\n\nthe time within which action must be taken as further prescribed by\n\nthis subsection. The Legislature shall have a period of forty-five\n\n(45) calendar days from the date on which the list is submitted to\n\npass a concurrent resolution disapproving any or all of the proposed\n\nprojects. If the Legislature does not disapprove any proposed\n\nproject by concurrent resolution by the end of the forty-fifth day\n\nfollowing the date upon which the proposed issuance is submitted,\n\nthe proposed projects shall be deemed to have been approved by the\n\nLegislature.\n\nB. Upon approval of all or any part of the list of proposed\n\nprojects, the Office of Management and Enterprise Services may\n\nexpend funds in the Maintenance of State Buildings Revolving Fund\n\nfor approved projects in the order of priority set forth in its\n\nannual capital plan.\n\nC. In the event an emergency has been declared as provided for\n\nin Section 130 of Title 61 of the Oklahoma Statutes, and as a result\n\nthereof, repair or maintenance of a capital facility held by the\n\nstate is required, a state agency may submit a request to the\n\nDirector of the Office of Management and Enterprise Services to\n\nsubstitute the emergency project for any other project or projects\n\nof the state agency on the approved current fiscal year's Capital\n\nImprovement Plan list, or to add the emergency project if the state\n\nagency does not have any projects on the approved current fiscal\n\nyear's Capital Improvement Plan list; provided:\n\n1. The Director determines that there are funds available in\n\nthe Maintenance of State Buildings Revolving Fund to cover all or\n\npart of the cost of the emergency project; and\n\n2. The Director submits information on the emergency project\n\nand the cost thereof to the President Pro Tempore of the Senate and\n\nthe Speaker of the House of Representatives and they approve the\n\nsubstitution within five (5) calendar days of such submission.\n\nD.
