There is hereby created in the State Treasury a revolving\n\nfund for the Office of Management and Enterprise Services to be\n\ndesignated the \"Pay for Success Innovation Fund\". The fund shall be\n\na continuing fund, not subject to fiscal year limitations, and shall\n\nconsist of all monies designated by state agencies to the Pay for\n\nSuccess Innovation Fund and monies which may otherwise be available\n\nto the Office of Management and Enterprise Services for use as\n\nprovided for in this section.\n\nB. All monies appropriated to the fund shall be budgeted and\n\nexpended by the Office of Management and Enterprise Services for the\n\npurpose of funding contracts as authorized by this act. Pursuant to\n\ncontract, the Office of Management and Enterprise Services shall\n\nprovide payment to private entities for the delivery of performance\n\ntargets and outcome measures at the direction of the agency engaged\n\nin the contract and only in accordance with the terms of the pay-\n\nfor-success contract.\n\nC. To the extent that any money credited to this fund for a\n\nparticular pay-for-success contract remains unpaid at the time the\n\nparticular contract expires or is terminated, as soon after the\n\ncontract expiration as is practicable, the Office of Management and\n\nEnterprise Services shall return the unpaid amount to the agency to\n\nwhich the money was originally appropriated.\n\nD.
