Each person engaged in the business of selling, leasing,\n\nmanufacturing, renovating or repairing any bedding shall have\n\nobtained an annual permit from the Commissioner to sell or lease\n\nbedding, or an annual permit from the Commissioner to manufacture,\n\nrenovate or repair bedding. Each person shall pay for such permit a\n\nfee to be fixed by the State Board of Health. Unless otherwise\n\nprovided by rule by the Board, each such permit shall expire on the\n\n30th day of June following its issuance. It is the intent of the\n\nLegislature that any fees authorized by this section shall not\n\nexceed the fees in effect on January 1, 1995, for the regulation of\n\nbedding and bedding materials.\n\nB. Each person who sells renovated or secondhand bedding or\n\nbedding materials on a consignment basis as an auctioneer, itinerant\n\nvendor or broker shall obtain a permit under subsection A of this\n\nsection. The renovated or secondhand bedding or bedding materials\n\nshall be sanitized by a person who holds a permit pursuant to\n\nsubsection C of this section before it is sold to the public. The\n\nprovisions of this section shall not apply to the sale of bedding at\n\na private sale by a person not in the business of selling bedding or\n\nto an auctioneer at private auction at the individual's residence.\n\nC. 1. No person shall be considered to have qualified to apply\n\nan acceptable sanitization process until such process has been\n\nregistered with the Commissioner and determined to be in compliance\n\nwith the rules, after which a permit shall then be issued by the\n\nCommissioner which indicates an approved sanitization process.\n\nEvery person to whom a permit has been issued shall keep such permit\n\nconspicuously posted on the premises of his place of business.\n\n2. Holders of permits to apply a sanitization process shall be\n\nrequired to keep an accurate record of all materials which have been\n\nsubjected to a sanitization process, including the source of the\n\nmaterial, the date of treatment, the type and time of treatment, and\n\nthe label identification number, and such records shall be available\n\nfor inspection at any reasonable time by authorized representatives\n\nof the Commissioner. Such records shall be maintained for a period\n\nof time to be adopted by rule by the Board.\n\nD. Pursuant to the Oklahoma Administrative Procedures Act:\n\n1. The Commissioner shall suspend or revoke or may refuse to\n\nissue or renew any permit issued in accordance with the Oklahoma\n\nBedding Regulation Act upon proof of violation of any of the\n\nprovisions of the Oklahoma Bedding Regulation Act, or any rule\n\npromulgated thereto; and\n\n2. Any person whose permit has been revoked shall be ineligible\n\nfor a bedding permit for one (1) year.
