Stat. tit. 63, § 63-1-1011","heading":"Health nuisances - Removal - Collection of cost of","body":"removal.\n\n(a) The local health officer and, if authorized by appropriate\n\nordinance of the city, the city health officer shall have such\n\nauthority as to any private premises within the corporate limits of\n\nthe city, and shall have the authority to order the owner or\n\noccupant of any private premises in the county to remove from such\n\npremises, at his own expense, any source of filth, cause of\n\nsickness, condition conducive to the breeding of insects or rodents\n\nthat might contribute to the transmission of disease, or any other\n\ncondition adversely affecting the public health, within twenty-four\n\n(24) hours, or within such other time as might be reasonable, and a\n\nfailure to do so shall constitute a misdemeanor. Such order shall\n\nbe in writing and may be served personally on the owner or occupant\n\nof the premises, or authorized agent thereof, or a copy thereof may\n\nbe left at the last usual place of abode of such owner, occupant or\n\nagent, if known and within the state. If the premises are\n\nunoccupied and the residence of such owner, occupant or agent is\n\nunknown, or is without the state, such order may be served by\n\nposting a copy thereof on the premises, or by publication in at\n\nleast one issue of a newspaper having a general circulation in the\n\ncounty. In the event of any conflict between the city health\n\nofficer and the local health officer of the county, the county shall\n\nprevail.\n\n(b) If such order is not complied with, the local health officer\n\nof the county or of the city may cause the order to be executed and\n\ncomplied with, and the cost thereof shall be certified to the county\n\nclerk, who shall add the same to the ad valorem taxes assessed\n\nagainst the property, and such cost shall be a lien against the\n\nproperty, until paid, and shall be collected in the same manner as\n\nad valorem taxes against the property, and when collected shall be\n\npaid to the local health officer, county or city, or successor\n\nthereof, issuing the order, for reimbursement of the funds used to\n\npay such cost.\n\n(c) Cities and towns may enact ordinances providing for\n\nproceedings similar to those authorized by the foregoing provisions\n\nof this section, by city and town officials, and the cost of\n\nremoving or abating any such nuisances may be added to municipal\n\nutility bills and collected in the same manner as such bills.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"31497d69973f573c366d72dbf952a3b58204cd2bc16f3b68467ee477a46d7f00","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-101","next":"us-ok/okla.-stat.-tit.-63-63-1-1013.2"},"notice":"GroundRules: Original legal text.
