The State Department of Health shall regulate public pools\n\nand spas. The Department shall not regulate:\n\n1. Spray pads, spray grounds, or splash pads intended for use\n\nby children in which the water is supplied by a system of sprays and\n\ndoes not accumulate above ground;\n\n2. Pools located at private residences;\n\n3. Pools run by a homeowner's association where pools or spas\n\nare limited to use by the homeowner group and their nonpaying\n\nguests; and\n\n4. Public or semipublic pools where the main objective is the\n\nexternal cleansing of the body.\n\nB. The State Commissioner of Health shall promulgate rules for\n\nthe safety and sanitation of public pools and spas, fees for\n\nconstruction permit applications, fees for operation license\n\napplications, fines for violations of safety and sanitation\n\nrequirements, and revocation standards for noncompliance.\n\nMunicipalities with a population of five thousand (5,000) or less,\n\naccording to the latest Federal Decennial Census, shall be charged\n\nno more than Fifty Dollars ($50.00) for construction permit\n\napplications and for operation license applications.\n\nC. All public pool and spa owners shall apply for a\n\nconstruction permit on a form designated by the State Department of\n\nHealth. Pool and spa designs shall be based on the International\n\nSwimming Pool and Spa Code, which may be promulgated into rule by\n\nthe State Department of Health. Construction permit applications\n\nshall include plans prepared by a licensed professional engineer.\n\nPool and spa owners must possess a construction permit from the\n\nState Department of Health prior to beginning construction.\n\nD. Public pools and spas shall be licensed annually by the\n\nDepartment. Public pool and spa owners shall apply for licensure on\n\na form designated by the Department.\n\nE. Public pool and spa owners must allow an authorized\n\nrepresentative from the State Department of Health access for the\n\npurposes of an inspection. Public pool and spa owners, managers,\n\noperators, and attendants shall be responsible for maintaining\n\nsanitary and safe conditions. All owners, managers, operators, and\n\nattendants in charge of a public pool or spa shall be responsible\n\nfor ensuring safety and sanitation requirements are met when\n\noperational. All pool and spa owners shall maintain records\n\ndemonstrating compliance and shall provide to the State Department\n\nof Health upon request. The Department shall report any suspected\n\nillegal activity on the premises of licensed public pools and spas\n\nto the appropriate enforcement authority.\n\nF. Every public pool and spa shall be secured for the purposes\n\nof preventing public access during the months in which it is not\n\noperational. Public pools and spas that are out of compliance with\n\nsafety and sanitation requirements during three consecutive\n\ninspections shall be considered a public nuisance. These pools\n\nshall be considered permanently closed by the municipality in which\n\nthe public pool is located. Permanently closed pools and spas shall\n\nbe completely filled in, or fully drained and secured by\n\nconstructing or utilizing a barrier adequate for the prevention of\n\nunauthorized persons. Municipalities may secure permanently closed\n\npublic pools and spas and charge the costs thereof against the taxes\n\nof the owner. Permanently closed pools and spas fully drained and\n\nsecured by a barrier shall complete the initial licensure process\n\nprior to opening to the public.
